Do you think it is NASCAR stopping the transfer of the #38 from RCR to HMS, or just negotiations? Also, do you really think it's fair to take the #38 from Guililand? I don't think so. They need to choose a number that is not currently in use, in my opinion.

I do believe that Nascar does have to approve the transfer of a number if the parties involved reach an agreement.

I agree with you Gloria. I too think they should choose their own number. A new number, new team and a new year!!!! Good Luck to Jr at HMS!

I think Nascar might be stopping it. Only because once someone does it then the next guy will want to.

At first I thought it would be cool for him to go with the 38 but now think he should just go with the 5. All those who got tattoo's with the 8 should just have gotten the name.

HMS has applied for a copyright trademark on 5 numbers with their specific font that they use on their race cars. They are the 81, 82, 51, 38, and the 58. Was reported on Sirius Nascar radio today. These patents were applied for weeks ago. They do not mean that HMS will get the number 38, just a precaution. If they do, then they already have it covered, and no one else can do it and refuse them access.

I didn't know the negotiations had stopped but if all parties involved agree to transfer the number then I think it is great. Jr wants a number that still fits his past identity but also creates a future identity that he has control of. I think it is a great jesture for RYR to do that. Can't blame him for wanting a certain identity. #38 fits well.

I find the whole debate over numbers and how NASCAR fits into this very interesting. I thought NASCAR owned all of the numbers and teams used them and had certain 'rights', but bottom line they belong to Helton and company.

I want to see Jr do well regardless of what number he runs next season.

Sheesh.... it's just a number! I, personally, don't think Jr cares one way or the other what number he gets, it won't change the way he drives & his fans will still cheer him on.

NASCAR has nothing to do with private negotiations. This stuff is only news because it's Jr. and Hendrick attempting to cut the deal.....which suddenly makes a number worth a whole lot more.

numbers are assigned to teams not drivers...dale jr could not keep his number because it belongs to DEI not jr himself and Gilliand doent own the #38 Robert Yates owns it
