Can they do it. My gal friend is on SS disabilty and has numerous things going on with her health. They told her they are going to deduct several hundred dollars from her check. Can they do it?
Also since it is personal income tax can't she go bankrupt on it. I know you can't on payroll check tax money but I thought one could on personal taxes. she just had surgery and will never be able to work again. She is 60 years old. Can anyone tell me more so I could guide her. She is beside her self. She lives with her daughter as her medical bills are so high she cannot afford a place and there is a 5 year wait for housing.
She will be in bad shape if they take anything from her check.
Please advise.

Obiviously back taxes on Capital gains she that she got after she got sick and had no income. she sold her house and lived on the money since she could not work. Her medicare does pay for medical doctors but not medication and not the 20%.

She is trying to get medicaid ...maybe people don't know it takes for ever to get any services ....since there are so many phony people mucking up the system. .

you don't mention WHY they want to take money from her s/s
checks. does she owe back taxes? it appears to me she might need a lawyer to help defend her in this case. yes i know she doesn't have any money, but she might be able to get some help if she could contact her congressman''s or senators office. i'm not kidding because that's what my wife and i did when she was trying to get disability from social security. she could also try to find THE DEPARTMENT OF AGING in her area or where ever they might be located.
in any case SHE NEEDS REPRESENTATION. my wife was also about 60 when she couldn't work any longer.
we found a lawyer who was willing to help and he did just that.
the department of aging is a good place to start. good luck.

IRS can levy on Social Security but generally does not unless the case is aggravated. There is also a more benign 15% offset of government payments toward government debts in general. She should go to the local IRS office or call the toll free number on her latest bill and show that she is unable to pay at this time.

When did she sell the house?

If she was unmarried at the time and it was after 1997, she should have gotten the first $250,000 in gain on the house tax free!

Could the return from the year she sold the house been prepared incorrectly?

I question IRS attaching her check and I question the medical bills, if she is on SSDI (real disabililty based on work---not supplemental security income) she would have medicare. And be eligible for medicaid for meds. Does she owe the IRS from employment????? Didn't pay taxes? She needs a tax atty, they will look into this based on a percentage. O.J. Simpson's pension can't be touched even by the family that won a civil suit.

the IRS can do what they like if you owe them money. And they don't need a court order to do it. They can garnish your check with little effort and no warning...

best thing to do if you owe them money is pay it somehow. beg, borrow.... owe anyone but them. They will get it, there is no use in running or hiding.

work out a payment plan, or offer in compromise... something.
