hi, just wondered if anyone could tell me what rights my sons father has!? basically i left him 10 months ago due to him sleeping around and got voilent after drinking, which at the time he did all the time as we managed a public house. In the ten months he has given me very very little money forwards our sons up bringing and very rarely makes an effort to see him. just recently he has started seeing someone else and wants to be able to have days out with my son and his new girlfriend. I have no intention of letting this happen, as can not guantee his going to bring him home again afterwards. where do i stand as to not let him have him alone. would this be legal??

Start gathering and documenting your evidence (including witness statements) of his abusive behavior and take it to a lawyer ASAP - and try to file for sole custody. If he ends up being granted visitation, then make sure they are supervised visitations. Although he does have some parental rights (how much probably depends on where you live) and you may not want to completely deny a father/son relationship, your son's safety should always come first.

Well it depends on what rights he is willing to gain for himself legally if you aren't willing to let him see the kid. As long as you aren't willing, he can't legally just come grab the kid of course, but if he took the issue to a court then he could gain visitation rights. But that would also reveal that he isn't paying child support, which he is obligated to do. But that obligation won't be fulfilled, in this case (from what you say), unless a court orders him to pay, which they would. So in both issues, it's a matter of pursuing the LAW, the courts. Nothing will enforce anything in terms of child support if you don't go to court to get it, and he won't have visitation unless a court orders it. He has rights as the father, but he also has obligations.

unless you have legal custody of your son, the father has every right to take the boy. please seek the courts help in setting up custody and visitations.
