A friend of mine's husband who is in the army slept with another woman, and she wants to know if he can still get in trouble even if she doesn't want charges brought. Apparently his company knows about it.

unless charges are brought he cant really get in trouble. If they are brought he could spend some time in the brig as well as face reduction in rank and loss of pay and allowances. I know of at least one marine (in the 4 years I was active duty) who served a 3 month sentence in the brig as well as reduction in rank from Sgt to Pfc for adultery once he got out he was separated from the military since he had more then 8 yrs in and was just a Pfc

Honestly, the truth is that if he is "in good" with his superiors, then there will most likely be nothing done. His chain of command has the ability and responsibility to at least look into the indiscretion. Another sad truth about the UCMJ is that they can twist it around however they see fit to punish him: with or without hard proof. I have seen many people get burned based on here say. Hope this clears things up a bit for you.

Adultery is considered unlawful carnal knowledge under Article 120 of the Uniformed Code of Military Justice (UCMJ). It does not require that the "other woman" file any charges. If his unit knows of it, they can take action under the UCMJ and he will face severe punishment, including dismissal from the service.

Creep Show: Just because your family chose to hang around and associate with people who were okay with cheating on their spouse doesn't make it prevalent within all of the Military. Yes, it does happen...but it also happens in the civilian world, too. This bugs me to no living end when people say crap like that. Especially when it come from the "I have a friend of a friend; my uncle told me" crowd who hear things second hand and take it as gospel truth.

The military does not take adultey accusations lightly. He CANNOT be charged without and admission of guilt or SOLID proof as in form of video, pictures, etc....Otherwise, all jaded wives will claim "cheating" just to get their husbands in trouble. too many wives nowadays take TOO MUCH solice in the fact that they could get their husband in trouble, ruin their career, etc if the marine hurts them. It makes me feel bad for the marine. Just because he is a lying cheating piece of crap doesnt mean you need to ruin his WHOLE LIFE! if he does get charged, convicted by court martial, he will go to the brig, then he WILL get a dishonorable dishcharge and no hope for a good life afterwards...why? All because he wasnt happy with his wife and cheated? thats SOO NOT RIGHT!

If you are wondering if he will get his $%^ beat by his superiors...definitly NOT. Quite honestly, if the chick is hot he might have gotten a few high fives and called a dumba$% for getting caught.

adultery is so common nowadays, it suprises noone. Take it from the wife of a platoon sgt. if we had a nickel for every marine that got caught cheating....the worst is on deployments, my husband would tell me stories of my friends husbands getting hookers, dating locals, etc! And, I CANT say anything to those poor wives!!

So, I have been out of the military almost a year now...
Adultery in the military is so common it's sickening, and one reason I got out..because i got married.
Anyway...YES, he will more than likely be charged with adultery, rather his wife wants him to be or not. The military has their own law system, and if you com mitt the crime you do the time....unless you have a really hook up, who gets you off the hook!
If his peers know about the incident, it's probably too late, and they make an example out of him. Depending on the branch of military he is in consequences could range from loss of pay, loss of rank, time in the brig or restricted to the barracks, and even be kicked out of the military all together. He better be on his best behavior, keep his head down, and work his *** off to redeem himself. Advise them to seek marriage counseling.

most unit's know within who's cheating on who and with whom. It's against the UCMJ but there's no way to 'get him in trouble' without bringing charges.

What she wants will have little bearing on the case. It's about good order and discipline in the military unit, not what's best for his family.

Yes, if his commanding officer finds out it is his duty to press charges.
