money has nothing to do with it......
she has a roof over her childs head and this child is always taken care of right??!! is she with the dad?? have her go to court the family law dept. get all the paper work she needs basically the paper work that says she wants to have sole and physical custody, if she can prove the father is a druggie she can get full custody. there is an application she can ask for that is a fee waiver of the cost to file this paper work she wil def. qualify so she wont have to pay 300+$ to file, it'll take about a month to do it all and there is no judge in this world that will grant a father the child and take the child from the mother....unless he can prove the mother is an unfit mother (which means a junkie, beats the baby, etc.) he CANT take the baby from the mother!!
tell her not to worry he's just trying to scare her...all he did was piss the mom off and now she will go to court get all the child support and he'll get everyother weekend and one day out of the week

tell her goodluck

There are alot of free legal help out there for low income families, all she has to do is research a little in her area. Since custody has already been granted to her ex, she may have a hard time proving she is better fit. i'm not sure what the situation is, but unless there are drugs or abuse involved, she may not be able to over turn the already said agreement.

Most counties in the US have a legal aid office. They operate on a sliding scale fee.

She can also request a lawyer to represent the best interest of the child. Usually the court appoints one though.

ETA: Representing yourself is a huge risk. With what is at stake (custody), I don't think I would chance it.

First things first this friend of yours needs to get a job. How is she providing food, shelter and clothes, diapers, etc for her and the baby? If the father has a stable job and is going to be able to provide a home and proper care for the child *diapers, food and clothes*, then the child should go with him. No ifs ands or buts. If the father doesnt have a job either then that child should be put in child services until either of them can prove themselves fit parents or given to family that is going to be able to provide for that child.

She should go to legal aid for assistance, but she should also GET A JOB! If she plans to sit on welfare and the father has a better setup for care, the baby should go to him. Stay-at-home mom is an option only for those financially able to do so.

not true! She doesn't have to have a ton of money to be a fit parent. And who can really afford lawyers no matter how much money they have really? There is legal aid, but she doesn't have to have a lawyer to go to court. She can represent herself, tell her to go to the library or online and look up law so she isn't uninformed or anything. She can do a ton of research herself and then go to court and plead her case directly to the judge.

Most state/county bar associations have pro bono programs if legal aid is not taking cases. Look in the phone book for fgree legal assistance programs.
