There is nothing to stop you two getting married in the USA. He may have problems when he files to adjust status after the wedding as you will both have to prove that he didn't enter America to marry you. It's very difficult to prove a negative.
If he goes back to Scotland without marrying you then you can file for a K-1 fiancee visa and have him back to marry you in around six months. If he leaves after the wedding you would need to file for a K-3 sposal visa.
USCIS tend to be suspicious of people who marry within a month of a visa or visa waiver running out as it's seen as an attempt to get around the K-1 or K-3 process.

It is too late to apply for an extension. You need to apply at least 45 days before a visitor visa lapses. You are allowed to marry, but he'll have to return to Scotland and re-apply to enter on a long-term basis.

You can marry if he meets the requirements of residency. He may need to go back to Scotland until it is proved that the marriage is for love and not for a way to become a US citizen.

Officially it is illegal to enter the USA to marry an American Citizen unless under a K1 visa, however so many people do it that it's not enforced.

Yes. I did that. My wife was Canadian and came down for the wedding. Later, but not the next day, she returned to Canada to get her permanent visa.
Edit:
For those of you who are alluding to the possibility of citizenship by marriage, that is not correct. My wife had to wait the full 7 years before she could apply for U.S. Citizenship.

im no visa extrodinaire, but im pretty sure that if you marry, he is then part of your family thus needs no visa and granteed admitance. You get people that stage weddings so someone can stay in the country.
