hi everyone, i have not worked for a few years due to personal family problems etc, a month ago i got a new fulltime job in a supermarket.
at my interview they asked me if i could work saturdays, i told them no as i have prior long term commitments, they said thats fine.
i noticed that on my contract they had put me in from 9 to 6 on saturdays, i went to my superviser and told him, he told me to go and talk to my other supervisor who would sort it out for me.
the second supervisor told me i could work on my day off (tuesday) and take saturdays off, that way i would still be working the 39 hours per week, i asked him if i needed to tell anyone else apart from him about this, he said no he would sort it all out.
anyway, last firday i was called into my managers office, he wanted me to explain the unatharized absences i had taken (saturdays), i told him what my supervisor had told me, manager told me he shouldnt have told me that would be ok, now i have to wait til the end of next week as just after talking to me my supervisor took 2 weeks off work, manager wants to talk to him, then i have to have disiplinary action and they said they might not even pay me as i didnt work my contract even though i worked my days off.
what do i do now? manager said it doesnt look good for me as im a new starter, i have been looking for a new job, but the way i see it im getting in trouble for doing what my supervisor told me was ok??

Write a letter stating EVERYTHING that took place.

Explain in detail what was told to you.

Ensure that you tell them that you will not accept being punished because you got approval from your supervisor and at this point, your supervisor is responsible for this, not you.

Get this all in writing and file it with your manager. Tell him that you will consult an attorney if action comes against you.

Make sure that you get a written response back from your manager that he has received the letter.

Make sure all of this gets put into record of the Human Resource office with the main corporate office.

They cannot withhold pay from hours that you worked. It sounds to me like this manager is on a power trip. He should not be using scare tactics on you without even so much as talking to the supervisor first. He is not professional. Complain to H.R. at the head office. If they are not helpful make a complaint to your government's labour department's office in your area. There is not an arbitrator in the country that wouldn't rule in your favour. I hope that you find better employment. You deserve better treatment than this.

As a Manager myself, if your immediate supervisor had been informed by you of the situation and he authorized the change, then it is now his responsibility. The Manager after speaking with you should have told you he would speak with that supervisor to see what happened. In any case, I don't see that you've done anything wrong.

Contract? What contract? Unless you signed something that said you'd work Saturdays, there is no contract. This is such bs. They HAVE to pay you for the work you've done; it's the law. They may fire you if they can (and in most states, they can, for no "reason"), but they can't withhold payment for work you've already done, and they shouldn't be allowed to bully you into doing something you never agreed to. If I were you, I'd contact one of those TV lawyers you see in the daytime and get him to take this case.

if you are in need of this job and the paycheck is going to keep a roof over your head, start working the days you are scheduled.if you haven't worked in a few years, Saturdays should be no problem, just use your day off in the middle of the week to do what you have been doing on those Satutdays

You're absolutely right - why should you get in trouble - its your supervisor who should be getting into trouble. Get yourself a union rep if they're going to take disciplinary action. USDAW is one union you could turn to (look them up on the net). They charge a monthly fee but they will help you.
