If a person gets stopped for a minor infraction of the law, i.e. no seat belt, no signal lights, or anything, and you've just come from church where you took Holy Communion (bread & wine), the wine being a small plastic cup, and the cop smells wine on you while you talk to him, can he get you on a DUI? There are young rookies who would do something stupid like that. That would be a violation of "freedom of religion." What do you think, besides "I'll drink to that!" ?

Where does it say in the details "a sip" of wine? Many churches use a small cup or a thumble would be more appropriate.
Wine is the drink for communion, not grape juice (juice for kids and adults who don't like wine).

I have had police officers tell me that they smelled alcohol on me, even when I hadn't been drinking. The best thing to do in that situation is submit to a breathalyzer and dui test. If all you have had is the small cup, it will barely show up in your system if at all, and they won't be able to cite you for a dui.

Now if you start arguing about religion and freedoms being quashed, they might look a little harder at your vehicle to find "something" to write ya a ticket for. It's best to be polite and answer any questions that they have. If you ruin the officer's evening, he may ruin yours as well. But if you are polite and well-mannered, they might be too.

No police officer, rookie or veteran, could or would give a DUI for just smelling alcohol on someone's breath.

That is the whole point to the SFST's (standardized field sobriety tests), the PBT (preliminary breath test), and the intoxilyzer.

No person can get drunk off of one sip of communion wine, so it would NEVER be a valid arguement in a DWI stop.

Your comment of "There are young rookies who would do something stupid like that." is completely off base with no basis in reality. Quit basing real life off what you see on the television.

Unless you have just come in to church after any all night wine party you should not smell of Wine. and not likely a police person would detect that small amount of wine. A brethalizer would have to sat a very sensitive level to pick this up. Tou should be ok.

You can only get a DUI if your blood alcohol is too high. Just because you smell like alcohol doesn't mean you are driving under the influence. Many people are designated drivers and smell like alcohol only because they were in a bar with their drinking friends, not because they themselves were drinking. In addition, the amount of wine you drink during communion is not nearly enough to to significantly influence your blood alcohol content. So don't worry, they won't convict you of drunk driving if you only had a little bit of wine during communion.

Just don't have a few beers after :)

We use grape juice, not wine, so no problem here.

And there isn't anything wrong with a rookie doing that if he felt he had just cause but I've not heard of any denomination that gives a whole cup of wine. You shouldn't be there to "party", you are there to remember the body and blood of Christ so wine actually is not necessary at all when grape juice services the purpose.

As long as you can pass a Breath-a-lyzer you should be fine. The olfactory evidence from a rookie doesn't count in a court of law, and unless you go to a very strange church, I doubt you'll get enough wine to be a problem.

I agree with VIN...Don't be silly no police officer is going to walk up to your vehicle and say "I'm sorry but you will have to come with me" With out doing what we are trained to do...Maybe you should start drinking the grape juice if "rookie"cops are giving you a hard time after church

If I'm smelling wine and you and you say it's 'communion' wine I'm gonna call BS and give you a FST to determine if you are infact operating under the influence (of alcohol in this case). As far as your excuse of violation of freedom of religion...that's a liberal excuse that tries to blame someone else (the police/government) for their (your) mistakes (driving while intoxicated).

When you receive communion (at least in a Catholic church) you have no more than a sip, which I am sure that you could not smell. Even if they did smell it there could be no way that there could ever be enough alcohol in your system to warrant a crime.
