About 1 years ago i met my current gf, she got pregnant and we moved in together. Well from the point she got pregnant up until now the relationship has gone to hell. She's abusive, manipulative and violent. I stopped talking to all my friends, stopped watching certain TV shows, stopped talking to certain kinds of people as well. We have had cops come to our place several times due to violent fights with her. I have cuts, scratches, and scars all over my body. I want out of the relationship! We have a 5 month old son together. I was going to wait until she has left the house to her relatives house after i drop her off cause we have only one car and then take her stuff and drop it off as well and change the locks on the door and never let her in again. Im also going to try to fight for custody of my son. Is what im going to do legal? I can't take it anymore, im not very happy right now. Were not married. How can i get her out my house if she won't leave?

The place is in my name and my name only. Sometimes when i want to leave she won't let me leave. She'll tell me to hit her instead.

I hate to tell you this, but the judge will 99.99999% vote for the women in custody cases. My friends wife ran off on him with some druggie guy, abandoning him and her kids for 9 months. After she had her fun, she came back and demanded a divorce, custody and alimony and child support. The judge gave her everything. She had to keep screwing up for 3 more years before the courts finally said enough and gave custody to my friend.

Google "fathers rights", and you will see the sad state of the laws for fathers.

YOU ARE A MALE you have NO RIGHTS.

Stop and think this out. If you were female, all it would take is a phone call to police and ask them to get you out of the house with a court order ro what they call AVO, DVO ect and you are locked out and lose the kids and thousands fighting for them.

First go to a store and buy audio and video recording devices. Make sure when ever you speak to the police after you have evidence, that you are scared of yours and your childs life, YOU WILL ALMOST have to wet your pants to look like a wimp and legitimate, wrong I know but that is the way it is.

Make sure you get evidence of as many abuses as possible. Physical, mentally, monetry, blocking you from having friends and financial ect ect.

Good luck, get some advise from a lawyer but try to get some evidence first and dont let them tell you to leave. Once you do you lose straight away.

What ever you do, once you start this (ringing the police to remove her) DO NOT be in your ex's presence at anytime without someone else as a witness.

I think you are going to have a problem with the son. If you leave, you will not have as much credibility when it comes time to fighting for custody. Seek some free legal advice before you do anything. I think things have to be done a certain way if you are going to seek custody.

if the apartment is in your name you can do as you have planned.you can also wait until she leaves change the locks and put it right outside your door. but before i made an attempt to move her out i would go to a lawyer and see what your rights are on moving her out and the steps yu need to take to get custody. this way you are protecting your self first.

You need to contact an attorney. Some states recognize common law marriages and others give people squatters rights if they have been living as common law spouses. If the house yours (or lease), because if her name is on anything, it can change the whole picture. Fight for your son, it sounds like he needs an advocate. Good luck.

you can definetly take custody of ur son, does ahe have a substance problem......u need to go to ur local foc and get a temporary custody paper and let them kno that u fear for urs sons safety and provide police reports and then when they set up a custody hearing u can either provide good reasons why ur son is better off with u and u will need proof cuz its very hard to prove a mother unfit.or u can tell the judge that u are concerened for his safety tell him whats going on and request temporary custody and request that she undergoes some form of treatment or counciling before she sees her son

You would be better off to get help to do what you want to do. You are a battered spouse. (Not all battered spouses are women.) Contact a battered spouse shelter and talk to them. Then the next time you have a fight and have cuts and scratches and bruises, you can go see them. They will also help you get custody of your child.

If her son is your son, and you have legit reasons why she shouldn't have him with her, then yes, it's legal. But wetehr it's right, depends on your reasons. Can you actually prove that she's not a good enough parent, for the child? It would be better for the child, if you and she remarry or marry.

Before you do anything get a lawyer. He will tell you what to do. If she is abusive she can be deemed an unfit mother. You can use police reports to back that up. Just dont tell anyone what your doing yet, see a lawyer so you dont lose your son.

If where you life is in YOUR name then it's legal, but it doesn't look good in a custody battle.

If where your living is in both your names, my advice would be too pack your stuff and find your own place too avoid any hassle.
