OK THIS IS THE REST OF MY PROBLEM FROM THE PREVIOS MESSAGE. I LEAVE SEPT 11TH, BUT I PUT IN A THIRTY DAY NOTICE TO VACATE ON THE AUG 31ST. I WILL NOT BE RETURNING AT ALL. THE APT MANAGER IS TRYING TO GET ME TO PAY EXTRA MONEY TO GET OUT OF THE LEASE. I THINK SHE DOESNT BELIEVE MR OR SOMETHING. I AM NOT ACTIVE DUTY YET. I WONT BE ACTIVE DUTY UNTIL SEPT 11TH. WHAT SHOULD I DO? I dont have the orders yet and i'm due to move out this friday. my lease is over sept 30th.

Technically, per the military clause on the back of all standard lease applications, you must pay the full month of which you are vacating. In your case, til Aug 31.

Since you do not have orders yet, you can get an official letter from your recruiter stating that you have sworn in and that you will be departing for the AF in early September. That should be official enough to get you out. It got me out of one of my old leases a while ago.

Now, that being said, your land lady can be an old bat and since you will be leaving in Sept, force you to pay all of Sept's rent due to the wording of the clause.

Good luck and be nice to her. It could make the difference between an extra payment or not.

You should have gotten a copy of your enlistment papers from MEPS. That copy is considered legal documentation of elistment, and you can use that to break the lease with out penalty under the Servicemembers Civil Relief Act. You will also want to send copies of your enlistment papers to all your creditors stating that you are enacting the provision of the same above act to demand that your debit interest rate be reduced to 6% as provided under Federal Law.

The Servicemembers Civil Relief Act may help you get out of your lease. You just need a copy of your orders.

Show her a copy of your orders. You should be able to get a copy from your recruiter. Once she sees those, she is required by law to let you out of your lease. If she tries to hold you to it, she can't, no matter what she thinks. Hope this helps.

The laws concerning leases with military members covers you with leaving so quickly especially if you can notify your land lord now due to joining the military TALK to your recruiter in the AM. !

Legally just because you joined the Air Force doesn't allow you the right to get out of a lease.

Maybe if you talked to the landlord and explained the situation, they might let it slide. Wait until you get your orders and show them, then it is up to them.

do u have any papers showing ur report date?...maybe show them that and see what happens...if not just pay the extra month so u keep ur credit clean cause believe me ur dirt will get up ranks and come back and bite ur butt if u let it go..good luck to you!

all you need is a copy of your orders. your Recruiter should be able to provide you with documentation.
