I think they generally cut off the BAH. If it is determined that he got it when he wasn't supposed to (ie, once the divorce is final) they will make him pay it back.

Hmmm, if it's only temporary (which I'm sure his chain of command recommended him move into a barracks) then no, because he had to get moved out the house due to problems. Once the divorce is done, he can choose to stay in the barracks, which would result in him giving up his BAH, or he can move back off post if he has enough rank (usually SGT and above) or if the couple have a child and he gets custody. I know soldiers who have done the same thing, moved into a barracks while going through a divorce because they still technically have to provide for their spouse, and its not officially a move, it's only temporary. The only thing that will stop his BAH is paperwork, but as long as his chain of command knows he's getting BAH and know his situation, and they're ok with it, then he's good:)

Any time that my husband had to stay in the barracks while we were still maintaining a separate residence (IE he had to move to a duty station ahead of us) he had to pay a fee for the room. In fact, anyone on our boat who lived in the barracks but had BAH or a wife in housing at another base had to pay for their barracks room when the boat was away for a year in refit.
I don't know if there are special rules for divorce cases but my guess is the soldier may end up owing some money per day while he's in the barracks.

Every soldier can stay in the barracks but they have to pay a small amount if they are getting Quarters Allowance. If he just moved in yes they can kick him out he needs to notify his CO that he is going through a divorce and needs to move into the Barracks. Depending on the quality of the soldier and the circumstances some leeway exists for a CO.

Yes, a soldier is not authorized BAH if living in the barracks. If that person is living in the barracks, then he is not elgibile for BAH.
It doesn't matter if that person is getting a divorce or not.

Yes.
The soldier is entitled to government supplied housing or BAH.
If he is married or has dependents, that means base housing OR BAH at the "with dependent" rate. If he is single he gets barracks or BAH at the "without dependent" rate.
It is one or the other.
You are not entitled to base housing AND BAH at the same time. However, on occasion if barracks space is available, they may permit you to stay in the barracks but they do not HAVE to let you stay in the barracks.

As long as your getting BAH you have no right to live in the barracks because the military is paying for you to live off post. The commander can decide to let you stay at the barracks if they choose but there is no obligation that they do so.

as long as hes still married he will still recieve BAH and as far as the barricks he can stay also and its free except the meal card :) they cant kick him out because what if the wife isnt living w. him yet (ig: shes finishing schooling in a diff state) she still needs the BAH and he needs the housing

A SSG (or any NCO)? No. A Commander? specific. however the Soldier could desire to be afforded a "lifelike" quantity of time to get perfect housing in the past forcing them out. And "lifelike" relies upon on a marvelous style of components.

my husband and i recieved BAH while he lived in the baracks because i was a dependent of his and he was stationed in germany while i was living in an apartment in the states till i could get comand sponsorship to go be with him it is ok to get bah and live in the baracks if you two are seperated example she is state side while you are overseas and living in the baracks but were married staying married and happy
with a divorce going on your suposed to actually notify comand of your divorce so you can get BAH taken out of your pay you can get in serious trouble for collecting pay that you are not suposed to i dont think you will be kicked out of the baracks but the army will simply just dock your pay till they get all of that money that you were not suposed to be getting in the first place it has happend before and is more common than you think
