i was invloved in a car accident. my car is totaled. i'm in pain. this is my first time and i would like to file a lawsuit. please give some advice how do i go about doing so. thank you in advance.

it was his fault. he ran a stop sign. i went right to emegency room after that. i dont have health insurance. my car is total. i now have to rent a car. my back, neck lower body is aching bad....

car belong to my parent but i drove the car. i just want to be sure my medical bill is pay for since i dont have health insurance. advice please.

First, you WILL need a lawyer.
Some lawyers may seek you out, and offer to take
the case on a contingency basis for 1/3 to 1/2 of the settlement.
THESE GUYS ARE UNETHICAL.
DON'T SIGN ANYTHING.
(1/3 to 1/2 is totally unreasonable unless you
need to go to court, and sometimes even then.)

If there was a police report, (get a copy), and the
other driver was insured, his insurance company
will probably seek you out and offer to settle.
Again, DON'T SIGN ANYTHING, but do get their
offer in writing, and ask a lawyer to review it and advise you.
(They charge by the hour, so have the accident report,
any bills you have, and any
other information you might need lined up.)
You can probably negotiate from there with your lawyers advice.

Why do you want to sue? A lawyer can handle your claim for you but you need to understand -- he/she/it cannot get you ONE DIME more than you have coming, if any. Add to that your 'lawyer' will walk away with 33% of any amount you recieve (if ANY). Besides, if the insurance company is handling the claim properly you have no grounds to sue anyone. Again, another colossal waste of money.

Why would you want an attorney involved? So you can give him a percentage of the money you *might* have coming, assuming you aren't at fault? That is why you have insurance. Turn it it, let them handle it for you.

Easiest way is to hire a lawyer. Let them take care of it for you. Ask friends or relatives for a recommendation or go to the internet and search one, car accident lawyer, personal injury lawyer, etc.. Make sure you move on it, time is critical. Go to the doctor and keep going to document your injuries and to be sure you get maximum value. You have to minimize your damages. Personal injury lawyers usually don't charge anything up front.
