I have obtained comprehensive since the incident but they said that since it was pre-existing, it would not be covered.

Can you wait until your house is on fire to buy home insurance? Can you wait until the burglar grabs your wallet to get credit card insurance? Can you wait until you fall off a ladder to buy casualty insurance?
No insurance can be purchased to cover events that have already happened.
You couldn't buy comprehensive cover after you discovered your car was missing from the driveway, then claim on the theft coverage, the windshield would be the same thing.

Yes, you can file a claim. And no, they won't bring legal action against you -- they'll do worse. At best they'll pay out and then on renewal up your premium drastically because they'll suspect fraud. They may also decline renewal in a year's time and circulate your name and details around all major insurance companies.

No point in trying to hoodwink the insurance companies. Now that they've started sharing data you won't win. Even when you have a legitimate claim, unless it runs to many thousands of $$$ you're better not claiming -- again your name goes on a list of claimants which is circulated around other companies. They've got you coming and they've got you going.

And if you got in a wreck on Monday and got insurance on Wednesday, that wouldn't be covered either. Insurance will cover things that happen that are covered AFTER the policy is in effect, not before. If it worked the other way, we could all drive without insurance until we had a claim, then sign up, get paid, and drop it again.

Now they know that it was damaged before you had insurnace. If you try and file a claim now, it will be insurance fraud and they could sue you for it. Just get it fixed and bite the bullet that is the fair thing to do .

The penalty for filing a claim now would be severe. they will prosecute and you would find it almost impossible to find car ins again.

SURE IT WOULD BE COVERED HOWEVER YOU BETTER HOPE THAT THE INSURANCE COMPANY NEVER FINDS OUT ABOUT WHAT YOU DID.

THIS IS CALLED INSURANCE FRAUD AND YES YOU COULD BE DROPPED, YOUR RATES COULD GO UP AND FRAUD IS A CRIME.
