My husband has a bench warrant from over 10years ago involving a traffic stop. He then moved to chicago before he was notified about going to court that's how the warrant was issued. Now in January 2008 he is traveling to Mexico with his Company on business he just go his p[assport today and my question is has anyone traveled outside the US and got back with no problems on a bench warrant? Also he is trying to rectify the situiation but they want him to go to court in Arizona and he cannot go anytime soon.

If the originating agency who puts in the warrant wants him Customs and Border Protection will arrest him on his return to the US. He will then be sent to Arizona where he will have all the time in the world to clear it up.

The only way he will make it through is if the Originating Agency does not want to extradite him. Don't count on that, I have seen people taken all over the country for what would seem like petty offenses. He is taking a chance if he plans on them not wanting him. If they do, I guarantee you he will be arrested.

Sounds harsh but we are obligated by law to arrest him if extradition is confirmed. Please ask him to take care of it before he leaves. I know he does not want to get arrested in front of his boss

It is possible he might just roll through but since it is Mexico..... there could be an issue. It is very likely that he will be arrested right on the spot. If he was notified he may have a failure to appear.

A traffic thing from ten years ago? They want him to appear in Arizona for traffic. Odds are you don't have the whole story. This is a problem that is far more than a trip. He sould beg off off the trip and take care of it. He can't go soon? Its your life too.

If you take a bus into mexico they dont ask anything they just say adios. I would take a bus fly to san diego take the train to border walk into mexico alot safer, yes airports might check because of disturbances on planes in the past. You can take a bus to california then a bus into mexico alot cheaper and be safe, then you can get an attorney in usa while in mexico to find out how you can get back into the usa. Really you should try to clear up those warrants with a lawyer though or make a court date, If you have a warrant for missing a court date you can walk into a court house get a new appoitment they will not send you to jail if you try to make things better.

If a warrant check is done at the border or airport then he will not be leaving, nor will he be allowed reentry without being arrested.

If he has a court date, regardless of where it is, he needs to go to it. They will have the court date regardless if he goes or not. If he doesn't, then another warrant will be issued for his arrest. Once he gets arrested on that warrant he will be transported to the jurisdiction.

Just take care of it and get it over with.

if the warrant is still active when he returns to the USA he will be detained at the state where he re-entered the country and went threw customs,

now will AZ extradite your husband say if he is detained in Chicago? probably not but it will be a few days before that decision is reached plus the embarrassment to be detained upon entry in front of his colleagues

I'm not sure, but I'm guessing if he gets stopped for any reason he'll be in a Hell of a lot of trouble! He should report to the case where it was issued (with an attorney) and get it taken care of. I'm pretty sure his company will be very mad about it if he doesn't tell them and then he gets in trouble.

With any luck they will snag him and send his scofflaw butt to Arizona where he will spend some time on Sheriff Joes Chain Gang. He had better make time to get it right or he will be "workin on the Chain Gang"

My Question is why he dident he take care of this concern then or now it's not like he is still a teenager
