Before I met my wife she was involved with a guy. Their relationship ended badly over a year ago. He tried to weasel money out of her after they broke up & he got nothing. Now, fast forward to this year. I had heard everything about the guy but had hoped he was something in the past. His mail was still coming to our house (he was using our address without us knowing about it for credit purposes) but once process servers and a sheriff came here looking for him, I began to point them to his place of employment & would forward his mail by putting a sticker on it with his address. I think he was unaware that I was the one doing it and assumed my wife was still single. Last Thursday someone destroyed our pond in the front of our house. I know he did it because my wife said that he had built the point and wanted compensation for it. Without any proof, when I go to court, do I attack his character? Everything I have is circumstantial.

Circumstantial evidence CAN be used in court however does not weigh as heavily as that of real evidence.

You can always bring up past events that support your allegation. Whether or not the judge will allow you to continue will only be determined when the respondant objects!

Read my profile. Local law enforcement does NOT comprehend stalking. I don't think they teach that in the academy. Start NOW logging every single thing that MIGHT be related to him. Invest in a few cameras - $50 bucks or less most places and a cheap VCR and make sure your wife always carries a camera with her. Evidence, evidence, evidence. The cops won't do anything without proof. You can probably get a restraining order and then if he violates, you'll have an action, but they won't hold him long on that.

If he's attempting to contact your wife make sure you save all e-mails, letters, phone messages, telephone bills showing calls he made to your wife (some cell phone companies provide both incoming and outgoing telephone numbers on their bills now) and contact the police whenever your property is disturbed or destroyed. Having written documentation will help establish harassment, and it might even be enough evidence to get a restraining order against him. If he violates that after it's enforced he will most likely be arrested.

If you get any more of his mail, return it to the sender with his new address so they can send collectors to him. The case sounds circumstantial for the pool, sorry! Unless you have security cameras with him on it, just fix the pool.
If he comes around again, call the cops. They are probably looking for him too.

okay....you married a woman who was involved with someone a little over a year ago? that may have been a bit hasty.

as far as your stalking question is concerned, go file a restraining order and report the pond vandalism to the police. then every occurence afterward, you have to report....so everything's documented. also, in your file for restraint, you will get to list everything that convinces you this is 'stalking'....which, at this point, it just sounds like one incidence of vandalism.

depending on your money situation, I would suggest that you hire a private investigator and get some photos of this loser doing illegal things that pertain to you and your wife.
In the mean time buy some pepper spray to keep you and yours safe, dog spray is the same as pepper spray and is legal to possess. Photos are worth a thousand words.
