we feel any amount comfort in thinking we could some day be back home together in america,we have made an effort to correct a mistake on our own, should our life be completly distroyed by the government or will we have a chance to live our life together in my home country of america in a short amount of time, thanks for any adult information you could give.

My experience with being married to someone who is/was illegal alien is that the person must return to his/her country of origin and apply for the citizenship there. Starting with the I-130 and affidavits, and eventually the I-601 which is a waiver asking to be pardoned for illegal entry/stay in the states. One thing that should be noted is the 3 year or 10 year ban that will bar the person from returning once they are out of the U.S., which is why you need that waiver. With enough letters of hardship the person can come back and complete the process. People told us it would take a few short months, but my husband has been gone since Nov. 2005. It takes a while, but you really have to stay on top of your case and turn in what they ask quickly and keep your info updated like your address if you move or things like that. The government does not care about breaking up families, even when children are involved. I handled all my paperwork without the help of a lawyer, but using one might make things go faster. As an American citizen, you have priority in sponsoring your wife for immigration. I know because that's how I came to this country legally. My wife who is a US citizen sponsored me and in no time I obtained my permanent residence visa followed by citizenship.

What ever advice you, get it will not be as accurate as what will come from a lawyer. I was told she can not get back for 10 years. If you could move, It might be advisable to move to a border town. I have heard of people who commute accross borders, but I don't know how easy that is.

If you are a citizen, then your wife can apply for citizenship as well. If you're merely documented, but not a citizen, then she has no legal protection.

if you get he here legally, you're all set..no one will bother you.. dont try to bring her here illegally, you'll have big problems on your hands... don't try to screw the government..you won't win.. just do it the right way...
