Shouldn't innocent persons walking on the street be protected from smoke that could come out of people's residences? What if smokers leave their windows open?

It should be banned in apartments because the smoke goes through the vents into other apartments. It's very unhealthy for anyone living there. Perhaps apartment managers/owners should assign a smoking area, away from the living space.
As for houses with their windows open, I don't think you could do much about that. It wouldn't be a lot of exposure.

I think that's really pushing it. There are other dangerous things in the air besides cigarette smoke escaping from peoples' houses. I think the amount that gets out really isn't enough to harm anyone. There isn't enough smoke in the air to harm people when smokers smoke on their porch or outside of their houses. Also, it would be an infringement on freedom. We've got enough of those, I'd hate to add any. Edit: Hey wrenchbender, I'm a big ole liberal bunny kissing bambi humping sandal wearing tree hugers. Don't make assumptions about how I live or believe. Your rant is cute, but way off base.

Really, aren't there bigger things to worry about? I understand the dangers of second-hand smoke and all, but sheesh, if you are that concerned about the smoke you might inhale from passing by an open window, I'm surprised you're not living in a bubble already...what with the pollution in the air and all.

Many people are allergic to smells. Should we ban certain foods being cooked so they don't get sick? Some days I really wish they would make smoking illegal so you worry warts would have something else to complain about. Mainly, making up the tax dollars smokers pay. That money will have to be made up equally by everyone.

More landlords (such as myself) these days are voluntarily choosing to make their apartments smoke-free. Such a policy helps reduce the risk of fires, prevents smoke from drifting into neighboring apartments and creating a nuisance, and also reduces cleanup costs when a tenant moves out. There's nothing as disgusting as having to clean all the tar off the walls when a chain-smoker moves out, and the smell lingers for months even when you prime and paint all the interior surfaces with several coats. A lot of towns are also allowing tenants to sue landlords who allow neighboring tenants to smoke if it drifts into their apartments and the landlord doesn't make them stop. I think that's pretty sufficient, and we don't need to completely ban smoking in private dwellings.

It is up to the owners of real estate, and their insurance companies, what should be banned to protect the public safety.

With private homes, I think the risk is more to people falling asleep in bed with lighted cigarette starting a fire, than the pollution effect of second hand smoke getting out of the buildings.

It is also reasonable to ban smoking in hallways of apartment complexes, where second hand smoke of greater nuisance to neighbors.

In the assault on freedom, that is probably next since non-smokers may come into someones home and have their "rights" abused by the owners smoking there.

I have heard this argument before and it is actually banned in 1 state in the US . However I will smoke no matter what anyone says because I for one , will never live in Nazi Germany .

Of course but only if they are smoking tobacco. If they are smoking weed the people outside should feel honored to get a free buzz.

Unless there is someone standing right outside the window, the smoke would dissipate fast enough to not be a hazard to anyone else. But I think it would be a good law, if nothing else it would help our society as a whole keep better health and live longer.
