What they said was that Robert Yates had spoken to NASCAR about a deal with HMS for the number 38. Nothing official, but sounds like it could be true. Yates can probably use the money and has no big monetary/emotional interest in the 38 that I am aware of.

I haven't seen or heard anything about it and I'm a big Yates fan.
Maybe if this does happen Robert will go back to using the #28

I just checked NASCAR.com and there is nothing on there about his number. There is a good article about him defending Theresa. He is not happy with the media because they are really on her for not giving up the 8. He says he is disappointed about not being able to take the number to HMS, but he is moving on and wants everyone else to do the same.
I am very interested to hear what number he will have next year, last I heard it was the 81 car, but who knows!
