Probably not. But I sure wouldn't pay that kind of annual fee for a credit card. Call and ask them to stop the annual fee or you're going to cancel.

I have Never paid an annual fee in on any of my cards .
Why would anyone pay fees ?
I also don't pay interest (pay off each month)
And have gotten about $1500 cash back over the last several years .
Refundable ? Of course , if you can talk the company into it .

If you used the card, you agreed with the terms and conditions. Annual fee may not be waived depends on what type of card. For instance, if the card gives you mileage like USairways, Alaska Airlines, cruise etc... fee can't be waived. Regular card such as visa, master card, yes, fee can be waived.

Only if you cancel before the effective date, before the year starts. But that's sure a huge annual fee - I'd drop that card.

No they're not refundable. Normally the annual fees are for the lower interest rate cards.

Annual fees are only charged once a year. I suspect they charged you $39 for a late fee. Most banks charge about a $40 late fee if you do not make the minimum payment on time even if the balance owed is minimal (eg. $5).

No, you can try suing for it back. But just do it as a class action suit. I got messed up in the whole foreign fees until I read this site. http://biyts.info/credit_card_fees.html has a good explanation of how suing does not help.
