A friend of mine, (a minor, 15 years old) was walking down some street, and he was approached by a guy who asked him if he wanted to buy some weed. He said sure, bought a gram. He went a few feet, pulled out his pipe and lit up a bowl, and instantly cops come out of the cuts and grab him (my friend, the minor) and bust HIM for BUYING from an UNDERCOVER COP??
This cop sold a MINOR marijuana, how is this FAIR???

aside from the entrapment, they provided him with marijuana. wouldn't that be as bad as a cop offering him a beer and letting him drink it?

It doesnt matter if you are 6 or 60, buying weed is against the law. Its not entrapment because your friend had the opportunity to say no and keep walking but he opted to buy thus making him in possession of marijuana. Also it sounds like it was a sting operation that was set up to do just what they did. The cops are well within the law to do this, just watch the tv show Cops. They do it on there all the time. He cant be put in jail, but he will be seeing a judge and could end up in juvenile detention or on probation for a couple of years.

NOT entrapment. "He went a few feet, pulled out his pipe and lit up a bowl" Reason... its entrapment only is he would never have intended to purchase it. In other words, he was not forced or coerced into buying, he bought on his own free will. The fact that he had a pipe shows the likelihood of intent and previous history. The issue that he is a minor, does not matter. It was still illegal.

ANYONE who asks you for weed on the street is a cop or at the very least a narc. I once had some kid approach me and was like "hey dude, I'm new in town.... do you know anywhere that I can get some dank??? ". I could smell the bacon waiting for me around the corner.
You can say entrapment but all the cops have to say is they just "happened to witness" a transaction and the other guy "got away". Then they hand him $50 and turn you in to meet their quota for a free toaster.

I don't know that the cop can make the offer. Your friend's lawyer will probably challenge that. However, your friend then pulled out his pipe and lit up ON A PUBLIC STREET? That was definitely breaking the law, no matter where he bought the weed. Considering that he owns his own pipe, it's not the first time, either. He doesn't have a lot of moral high ground.

There is more to this story.
This is why I appreciate Law Enforcement SO MUCH. How would you like it, if someone constantly came up with unfounded accusations about your job performance? I am guessing that you are close in age to this 15 year old therefore you will be unable to grasp what I am saying; however please know that distorting the facts is of no use to anyone.
Your credibility will weaken.. this is a very small world and despite your age you are creating a reputation for yourself. Be wise. Stick to the facts and choose your friends wisely. It is not a game.
Support Law Enforcement rather than trying to make their jobs harder... hey, now there's a concept. If you think you can do better.. make sure to show up at the USMC recruitment office on the day you turn 17.. and let them know that you're ready to risk your life for strangers.

It's not fair, but at the same time the kid shouldn't have been buying weed in the first place! I don't really know if it's legal but the kid still bought drugs. Isn't this the same idea as having a 15 yr old SELLING drugs to an undercover cop rather than buying?

I'm glad he got caught...he obviously isn't too bright buying it from some random person off the streets. Second of all, why would he light up a few feet later in public? My oh my kids are dumb these days. It's not illegal, it's a sting op, just like everyone else is saying.

It all depends on where you live. If your state is liberal or conservative....In my state...that would never fly. I have been involved in many investigations where we would offer illegal items to people and bust them if they took bought it. Now days, we can't do that anymore because they claim that it is entrapment. I personally think that it doesn't matter who offers the drug...it is your decision to buy it and then smoke it. Either way, its all illegal. Check your state laws or write your congressman, thats what I would do.
