Assuming everyone is healthy. Can I legally take the baby with me?

The reason why is that they have a 3 day stay at my hospital and they don't allow rooming in, the baby has to go to the nursery. The baby is taken one hour after delivery, no exceptions and they father has to leave after visiting hours, even if you have your own room. I don't think separating us all is great idea. It makes breastfeeding difficult. Plus the hospital is well known for being filthy.
I don't worship the almighty doctor and I do believe that the mother most of time knows better than anyone.

If I were you I'd consider a different doctor/hospital if you have concerns about their policies. You need to check with your state laws on this one. I know with my son they didn't even tell me I needed his doctor to clear him to go home. My doc said I could go and we left. Got a call a few hours later saying the baby wasn't released and I asked if they had a good reason for keeping him another day. They said no and I left it at that. Just be sure to have your baby checked by your pediatrician within a day or two to check for jaundice and to do the second PKU test.
Even if they say no you can't take the baby unless that baby is having some kind of a serious health issue you can still take him with you. At most I'd assume they'll make you sign a form stating you left against medical orders to cover their own butts.

It varies by hospital and state but the general rule of thumb is the baby has to stay in the hospital 24 hours. Mothers can leave AMA whenever they want.

With that said - can you look into delivering at a different hospital? There is no way in hell I would deliver one of my babies at a hospital I was not 100% comfortable with. Sure, all hospitals have some annoying rule or another.... but not letting the baby stay in the room with you??? Thats obscene.
And the fact that its filthy? Ew. I would really explore other options if this is at all possible. Good luck!

That's a tough question. You can leave against medical advice but the hospital wont be responsible if anything happens. As for taking the baby with you.. I don't know that they could keep you from taking YOUR baby if everything is okay. Women have home births all the time and of course no one goes to their home and takes the baby away to the hospital. Talk with your doctor about how soon s/he willl let you leave and not be going against medical advice. I was released from the hospital within 12 hours after my first child was born 14 years ago. It meant spending the night since he was born at 11 pm, but since we were both doing great, the doc let us go.

You can leave against medical advice and it's up to the pediatrician if the baby can leave. Many require that the baby stays in the hospital at least 24 hours, sometimes longer depending on certain situations.

yes you can discharge yourself and the baby before the hospital stay is over but remember when you do this you are signing a form that you are going against doctor's orders and their medical advice and if something happens to you or baby you cannot legally do anything about it. I hate hospitals myself but when you give birth you are out of their usually within 48hrs so I would just stay. Your not going to want to run a marathon after birth anyway so enjoy your rest.

I believe you can but it would be best to wait until they say it is ok because certian problems don't show up until 24 hours after delivery like jaundice and also the baby will need to receive a hepitis shot.

Wow I don't know what hospital you go to.But in Chicago here the baby stays in the room with you and the father can stay all night with you and the baby.Why you so in a rush to leave.

Absolutely, but in some states, if the Dr can give good medical reasoning for your baby to stay, they can keep him/her. Sometimes Dr's are wrong and we need to take ourselves and the care of our children into our own hands. I wish I would have done that with my last child. They told me that my son needed to stay for bogus reasons, and it ended up causing some problems and could have ruined our nursing relationship. I wish I would have just signed out AMA and took my son home instead.

You can leave if you really push the issue but they will not let you take the baby with you until they allow you to sign the baby out.

Go ask your hospital when you preregister. I would think so though, but I would stay there for a minimum of 24 hours to be on the safe side. Good luck!
