He says it's not for him. The recruiters lied to him about going to college and about him "Not" having to go to Iraq. (I warned him) Now his reserve unit says "You have to go to Iraq" and he says he doesn't want to go. What now?

Well, he should've done his own research if he had any doubts. Also, how did he join the marines with a war going on and not expect to go??? He's going to deploy unless he goes AWOL, which I would NOT recommend. If he joins an anti-war protest group and shows up in uniform, all he's gonna do is get slammed, busted down to E-1, and he 's STILL going to deploy. There's no way out of a deployment, except like I said AWOL or if he shoots himself in the foot, which would get him in trouble yet again and he would STILL go to Iraq once he healed. Tell your nephew to suck it up, if he wanted to go to an "easy" service he should've joined the Air Force and been a fly boy. All he can do now is finish out his time honorably and take it as a lesson learned. And he can look at this way too, he gets the Montgomery G.I. bill when he gets out. It's not as bad as anyone thinks it is out here, this isn't the Korean war or Vietnam, the living conditions are not as bad as they used to be. Best of luck, oh and P.S. I been here 10 months already with 5 months left, marines only deploy for 6 so he needs to suck it up!

The military is not scared of the ACLU. They wont care. I know several people in the military that support the ACLU. The military in general does not like the ACLU because the ACLU is destroying the country from within in many peoples opinion.

The problem is that your nephew failed to meet the obligation he VOLUNTARILY signed up for. He is a failure and I have no sympathy for him as Im sure many do not.

When he joined a year ago, did he really not expect to be deployed? If he wears his uniform to a protest to try and get out of his obligation, I hope he ends up in a cell. He is now leaving a hole in the ranks that other depended on him to fill. His going AWOL, or leaving in protest is the same as if he was shot by the enemy. His unit is short a man they need, but if he leaves without fullfilling his obligation, I guess he was never a man in the first place.

He signed the contract. The recruiter may have snowballed him but your nephew didn't do his homework about the Marines. There are no guarantees unless stipulated in the contract. The contract says, grunt first - specialist second.
Might as well tell him to suck it up and finish his contract. If the Corps want him to remain in the service after his contract agreement is expired, then you have a case. As for the ACLU, they're busy representing the inmates classified as terrorists against the U.S. in Gitmo.

You asked a lot of questions, so I'll only answer 1 or 2. First of all, if your nephew enlisted for a 4 year hitch in the Marines, he is obligated to serve 4 years. There are several ways out: Wear his uniform while protesting, get arrested, get court-martialed, get a dishonorable discharge. Or do some other crimianl act= same consequences+ prison time.
Tell your nephew that a military obligation is exactly that, an obligation. He should quit whining and serve his tour of duty.

tell him to stick it out. hes already a year in. the benefits he will get when his duty is done will far out way the consequences of getting anything other than an Honorable discharge. look up the USMJ on wearing his uniform to an anti war rally. what did he join for? when you join a military service especially during war time you have to expect on going to ...well war. have him call the Inspector General ( I.G.)
to see if his contract was frauded if his recruiter did lie to him.
what is his millitairy job? not all jobs see actual combat.
he is probably just scared about going as i was. it was the hardest thing i have ever faced. in the end i have made freinds on a level that i never would have made in civillian life. Hopefully he will stick it out. an hanorable discharge at the end of his contract will open up maney doors. actually being a war vet opens up even more doors

The answer is no he can not get out. My daughter is serving in Iraq and she was made a few promises by her recruiter. She has 3 small children and that had no impact on her going to Iraq. They both signed a contract and will have to live with their decision until their enlistment is completed

Your nephew is a coward and he doesn't know how to read. The final lines of his contract read, along the lines of... Anything promised to me but not written in this contract is null and void, so if the contract didn't say he would have to go to Iraq why would he have thought that. Your nephew needs to suck it up and drive on. He signed up to be a marine now he needs to act like one. I'm surprised the ACLU is even talking to him which one of your nephews civil liberties was violated when they told him he had to go to Iraq? Your nephew needs to quit being a coward and learn how to keep his word.
