Should thoy check in to the immigration department or just buy the air ticket and go....will they have problems at the air port?

At the airport they will ask for your exit visa/ green card and they will record that you overstayed, that means that you have to apply for a visa prior to your next visit, they won't stop you leaving or anything though, I once lost my green card, they said I may have problems on re entering but I didn't a few months later.

I had the same problem as you, I found that if you get a taxi or friend to drive you across the border to Mexico then fly out to your home country, there is no record of when you left as the Mexico immigration do not ask you for anything.

When you get to home country get a replacement passport. When you come back to USA the system does not flag you as an overstayer or staying too long, so you can start clean again.

I once was on a plane from Mexico to Los Angeles on a trip to get my I94 visa waiver restamped, on the plane I met a guy from the UK too, he made the mistake of flying fom Los Angeles to Mexico on a round trip ticket, he went out from LA the previous day and was on my plane on the return trip.

When we got to LAX I got through no problem, no questions, he was stopped asked questions, interrogated and asked to book his own flight back to UK that same day, they said he would be allowed back in if he waited 6 months before returning. The reason they gave was he has to fly back to his home country (not the nearest one) and he could not stay for most of the year as a tourist as he would be suspected of working in the USA.

If you ever fly directly from USA they record it so when you come back after a few weeks it will flag you as having just recently left so you passport will be looked at more closely to see if any rules have been broken.

With all the automated checks in the USA, fingerprinting and iris identification, the computer tells the immigration of any issues about you as soon as your passport number is entered so they don't look at your passport closely anymore unless you are flagged by the computer.

Sounds like you have some good answers but my take is; a passport is used when traveling out of the country. In the US we didn't have to use it before to go to Canada or Mexico. The newer law (for a few yrs now) says we need it. Even on cruise ships. A visa is needed for a certain length of time in a country and if you are going to be working in that country. The government links should clear it up for you.

I would think countries would be more concerned with people entering than leaving. Besides, I would think an expired visa would be ample reason to be going back where they came from. Trouble is, most don't want to go back home when the visa expires. They want to stay and work in this country. It's not the ones leaving who are the problem kiddo, it's the ones who are staying!

they should not have a problem leaving. It would be if they wanted to return and it shows up that they had overstayed their visa.
Just buy the ticket and go.

US immigration system don't stamp "EXIT" in the passport like other countries do at the Airport!!!

Do you need a Visa to return home?

I thought Visas permitted one to visit foreign nations.

Book a ticket and go home, the passport will be scanned when they leave the USA.

I should think there would be no problem in leaving, but do not every plan on coming back. Would think that that person is now illegal in this country.
