I was totally wasted when I exited this club. The club was in Hollywood, and had alot of drug activity going on. Apparently I ended up leaving with some pot. That some other drunk guy gave me. We were just having one of those drunk conversations. Like an idiot "I know", but i swear I was not aware. When I came out I was pulled over, and searched. Apparently the officer said that I threw the pot I had. I did not denie it, I was drunk. I mean drunk. Could I get away with it, if the officer did not take me to jail for public intoxication?

Definitely, you will receive a greater penalty for the subsequent offense because you violated your probation.

Things do not look well for you. If you are lucky enough to get yourself out of this I would definitely think twice about getting myself into that situation again. If you plan to drink alot at least do it in the safety of your own home and away from people you don't know. Drunk or not, you are still responsible for your own actions. Also, as far as not being aware of your actions, it doesn't take a rocket scientist to figure out that you did infact throw the weed. He wouldn't have claimed that you did if he didn't see you doing it and he obviously knew you had pot on your person some where so I am guessing he also found it after you threw it. You need to govern yourself better than this or you may not be as lucky the next time around. If you choose not to, than anything that happens to you is your own fault.

No. The court is not interested in your "reasons" for violating your probation. In the eyes of the criminal justice system, deviant acts resulting from lack of self-discipline, ignorance, or stupidity are what probaion is designed to nail you on. In other words, the purpose of probation is to test how you can function in society among other people as a way to assess the success (or failure) of your punishment/rehabilitation. You failed that test.

"Voice of Liberty" hit the nail on the head. Absolutely! I could not have stated it more eloquently, and accurately, I might add. Well done!

When you speak to your probation officer, pray he does not paint a bad picture for the judge before the judge makes a decision regarding your case. Good luck.

Has it occurred to you that you have a problem with alcohol? Being "totally wasted" is not a good thing. I hope you weren't driving when you were pulled over. If so, you endangered your life and the lives of innocent people. Get some help before you kill yourself.

You violated probation? You're f*cked, unless of course you're a celebrity, in that case most of america will likely throw a huge pity party for you.
