How do you resolve identity theft where it was you own father who stole it?

My husband's dad took out a credit card in my husbands name. The family has been split up for about 5 years. His dad and mom got back together and he is now talking to both of them. It is very sticky situation. He told them it was his father, he denied he ever did it and the agency sold it to another agency. Now that they are talking he has to do it all over again. He talked to his dad and his dad said he didn't have the money to pay it. He doesn't want to get his dad in trouble. Is there any easy way to fix this? Anyone with any experiences?

Need to take him to court like the criminal he is. There is no excuse.
