there are a few people at my job in upper management that I don't get along with. I do fine with my staff and coworkers, but for some reason they have felt it ok to talk sh*t and I personally dont take it. my immediate boss and I are cool, but a few of those around on the account we've definitely had our words. I believe in a lot of respect and these people just dont have it. Since they are senior than me, they've asked that I be switched to another account. Its happened with 2 people that are really in need of getting laid in my opinion. The work i do is really good however. Always on time, I spend a lot of time making sure things are done correctly and professionally. Its just these personality clashes. I'm wondering if just based on your interactions with someone is that just cause to be terminated. I know I can "bite my tounge" or "grin and bear it" but quite frankly thats not the advice I am looking for. I want to know legally can I be let go based on the relationships. Thanks!

Yep, they can fire you for whatever they want, except for things that have laws to cover them.
Most places of work evaluate you on your ability to get along with others, and some really value it.
Both of my current jobs have changed their policy on customer relations. One gave us training, and said if we can't get along, we would not have a job there. The other says that administration has no more priveleges than the workers, everyone is evaluated the same. Both say that everyone is your customer, administration, service staff, the workers, people in other places, and of course, the customers.

Yes, you can be legally fired for your bad experiences with management, even if they really were the ones out of line. Getting along with other people in the company is part of your work, and it can be proven that you don't have the skills to do that part of your job, due to the paper trail from being switched to other accounts. Other laws may apply if you are not in the US, but I think this is safe advice just about anywhere.

"legality" will have little, if anything to do with your firing.

The ability to get along with coworkers and supervisors is a vital work skill. You sound lke you have a hard time grasping that concept.

You may be the hardest worker. You may be the smartest. But your attitude is poison in a place of business. You conflict will eventually cost the company in terms of lost productivity and wasted time (the next time a boss has to smooth hurt feelings or calm people down whom you've ticked off.)

I would not have a person like you on my team. I'd get rid of you if it meant writing you up every time you were 1 minute late coming back from lunch.

It really depends first of all if you are working for an at-will employer, which means they can fire you at any time for no real reason if they would like. A lot of companies are like that now. You should ask HR about that. They will know what you mean when you ask if they are an at-will employer. If so, yes you can be fired if the higher-ups dont like you. They will find a way to squeeze you out.

Legally, you cannot be fired for having a difference of opinion with people you work with. If you are fired without good reason, then you have good cause for a wrongful termination lawsuit. If you live in an "at will" state, you can still get unemployment compensation if you are fired without good reason.

Technically, no, you can't legally be fired because they don't like you. But if they don't like you enough, they'll just make up some BS reason to fire you, or they'll be watching you constantly waiting for you to make a mistake. Your best bet is to either change what they don't like about you, or get out of there because they probably won't give you a good recomendation either.

It depends on what state you live in. Ohio, where I live, is what's called an "at will" state which means that you can be let go for any reason that isn't against federal labor laws. And yes that would include personality conflicts with management at any level. Most states are at will.

My advice to you is to pull your head in & get on with your work. You spent quite a bit of time telling us how good you were - so that should be no problem, would it?

You'll soon learn that as a junior worker, in any organization, you wont get far by trying to tell senior workers & management how to do their job - that what seems to be going on here.

Just remember your position in the pecking order......

Yes, unfortunately, they can fire you. However, as has happened, they'll more than likely move you around. Also, a common tactic is to cause you to leave by annoying you.

If it's a good company - ride it out. That's what I've done many times to their chagrin. And I've won in the end.
