My van blew a head gasket and it will cost more than it's worth to fix it. In other words it's junk and needs to be towed away to a junk yard.

It's not paid for so the bank still has the title. When I filed a chapter 7 bankruptcy I told them to come pick up the van. Because it's junk they don't want it and won't come get it. Because I don't have the title I can't find a junk yard that will tow it.

The bank refuses to give me the title or tow it away. How do I get rid of it?

I would have it towed to the Bank's parking lot.

In most states, the "Statute of Limitations" on "legal" collections of debt are about 3-4 years, with exception of certain bankruptcies. If the car was part of the bankruptcy, you should consult your attorney.

Otherwise, you can post an ad in the newspaper advertising "abandoned property". Check your local laws to see how long you have to run the ad, maybe as long as 30 days. At the end of the time frame, if no one claims the abandoned property, you can take steps to dispose of other people's property on your property.

without a lien release you will have to pay taxes on it every year anyway,but you can take the van to a scrap metal place and they will scrap it. or it might be worth the tow bill to have it towed to the bank and park it outside their door , they have the title it's theirs lol. anyway good luck getting rid of it.

Looks like your in for trouble, but, if left on a city street long enough, the city will tow it and bill you for it. (Storage fee as well as towing.)
You will still have to pay for it no matter what happens.
You might advertise it for parts, that way some one wouldn't expect it to run when they buy it.
No matter what you do, you will wind up paying for it.

They could probably still take the car without the title. they would just give you less money for it because they would need to apply for a lost or abandoned car title to legally have ownership of the car.

well it may be junk to you but perhaps i could help you out frist off how much do you still owe in order to get the title if you could change the name to whom is buying it then i could pay the outstanding and get the title and get my dad to fix it up for me for free then i only have to figgure out how to get it to winnipeg canada also is the car standard get back to me right away and maybe we can work some thing out
