This is one of the most unfair laws ever written. Why should I have to give part of my retirement to a cheating spouse? This law it totals B.S. Luckily for me, the judge gave her nothing. The reason why, the military doesnt determine it. The state government determines how it is divided just as any divorce settlement is done. The military has nothing to do with it. You have to go back to court and have it put into the divorce decree. So asking the Department of Defense is the wrong answer.

No offense, but that is the most ridiculous, stupidest law in existence. My husband is going to have pay his ex-wife 30% of his retirement when he does retire. Why? Because when he deployed to OIF 1, she decided to sleep with half of the african-american male population in her city while my NOW husband was busting his a** fighting a war. She was so into her new little boyfriends that she was busy with her legs up in the air and the kids played with matches, burned down the house, and one of the kids got hurt. My hubby came home cuz of the fire, found out of her unfaithfulness thru the kids and decided to divorce her. But as an added bonus (on top of him paying her lawyers, and being left with only the clothes on his back since she burned the rest), she gets 30% of his retirement. That's bulls**t. Just thought I'd speak my mind. Again, no offense, but I don't think any former spouse should be entitled to something that the service member worked their a**es of for. The soldier is the one who fought the wars, endured the long weeks in the field, NTC, early mornings, late nights, not the former spouse, regardless of what the soldier did to get divorced.
