IF some female's boy friend records their sex related & mutual private conversations through HIS mobile phone WITHOUT her consent or permission ;
after their break up he becomes hostile ; makes few other people to listen those recorded talks & tries to lower her moral and character.
Besides filing a case of defamation againt him ; can she also file complaint for violating Information Technology Act India regarding:
section 67 –transmission of information obscene in electronic form ;
section 72 – breach of privacy ,against that hostile
ex-boy friend ???

A case of defamation under section 500 of the Indian Penal Code, case under section 509 Word, gesture or act intended to insult the modesty of a woman, case under Section 292 & 294. Obscene acts and songs are few of the options in your case as the facts mentioned by you, but sorry not under section 67 or 72 of the I T Act. Section 67 of the I T Act applies if the complaint is made by the person who receives such message or information transmitted electronically & section 72 applies to person who enjoys, in pursuance of any of the powers conferred under this I.T.Act.

yes it can be done. But are u in India. If this matter goes to police and then to court are u ready to accept that u spoke what ever he has recorded. If u understand about Indian Mentality ( dont mix up with tradition and culture ) who will first bear the brunt of it. think about all this first, are u ready to face all related social problems, go ahead, file a defamation case.

what kind of jerk tapes conversations with a girlfriend? what is this world coming to if you can't say what you like to a person without them turning on you later? i think the courts would laugh the guy out the door if he tried to prosecute her. but yea i think she can get him for taping her conversations without her knowledge. you have to let the other person know you are taping them now. wish i were a lawyer, with all the stupid things people sue for now i'd make a killing.

yes, I T Act can be applied. because it ruin the moral of his or her and also turn other to this path which is totally ofendable. we have no right record any bodies private matter wheather it is of our friend
