my boyfriend got caught with a small roach that belong to me. he had took it away from me because he is in probation and he cannot be around it at all. unfortunately i wasnt thinking at the time the girl gave it to me, and i got mad because he took it away and he pushed me away and he got caught by a sherrif (puhing me away). he is first of scared to go to jail for violating probation, he never got into any trouble he is a good kid, not a gangster, has a good job. just got intervewed and most likely got a job with the County. Hes gettign a drug test tomorrow to show that wasnt his. how can i and who can i approach and tell that this belonged to me and not him. should i go look for the police officer that issued the ticket and explain. is it likely he will go to jail for something that wasnt his. can i do anything. please help hes getting r=wrongfully accused and the officer didnt believe him. someone please. can i call somewhere. can we ask for the police report to see whats in it????

Anywho, the problem is the interpretation of the law is simple: Possession is 9/10's of the law. If he had it, he owned it. What you are suggesting may cause both of you to get into more trouble. Honesty is still the best policy. But, we are in America, so you NEED a LAWYER really bad, or should I say, he does.

He may be able to beat this with a good Lawyer.

He's on probation? Then talk to his parole and probation officer. The fellow he's supposed to check in with on a regular basis. Confess to the p.o.

Check into rehab, then call the prosecutor or the police from rehab to explain. By checking into rehab, you'll not only get help, but the police most likely wont press charges against you for taking the initiative to get clean. You might not like this answer, but its all I got.

Most likely he won't go to jail for it just the ticket. Next time he has to talk to his PO go with him and tell his PO what happened and his PO should work with him.
