I'm wondering if I am going to be denied unemployment if I am pregnant? The requirement is you must be "ready, available and capable of working full time" and being pregnant, you still are capable. If at first I put on the form that I was unable to work full time, which isn't true but I botched it, but then spoke with someone over the phone at the agency afterwards and told them I could- they said I had to wait until I receve paperwork so I can fill out an eligibility form and then they sent me a medical form I had to fill out but I just sent it back and said that I have no doctor or medical condition I would need one for so we can just clear up this mess... now they say my account/case is impending investigation of availability and I'm not going to be paid until a decision is made (in my favor). So I don't know what the heck to make of it all... does anyone have any knowledge or experience w/ unemployment?

you goofed on the form and they need to make sure you are able to work full time. If you have no issues with your pregnancy than you should be able to get benefits. It justs says if you can work a full time week not if you are going to be able to keep the job because you are planning to have a child. Why don't you ask for the medical form and take it to your doctor. Make sure he has no restrictions because that would make you ineligible for benefits. Talk to your caseworker and see if you can take them the completed form so the investigation will go away. That's all they are needing is proof that you can work.

The main requirement for unemployment is that you are ready, available and capable of working full time. It also means that you are actively seeking work and that you let them know each week where you applied to for work. (You have to send them a list of places you have applied to and they have to be reasonable. (in other words you aren't sending in resumes to places that you are obviously not qualified or able to work at) If you spoke to someone at unemployment and told them that you are pregnant they are going to ask you for medical certification as to is it safe for you to work or did a doctor order you to bed rest. It is not discrimination to deny you unemployment if you are not able to work (as another poster on the site stated). If you were injured or ill the same rules would be applied. If someone is unable to work due to illness, injury or pregnancy then they may apply for disability (either state run if your state has a program or if you have a private plan for disability) or through social security disability if your condition qualifies for that.

Go to your prenatal care doctor and get a note allowing you to work full time. You need prenatal care even for a normal pregnancy to assure you don't have unknown problems and to advise of diet, exercise and other issues.
By the time to straighten this out you may already have a full time job which would prove you can work.

You can get unemployment if you were laid off, it shouldn't matter if you are pregnant. If they use that as an excuse, that is discrimination.
