I have an old knee injury that flares up every now and then, and as a waitress, it happens alot. I recently called into work saying I could not work, and I got treated very rudely. I came in with a doctors not, and I got more rudeness. I went in today to get next weeks schedule, and to find out if there was anyway I could not work tomorrow as scheduled, and once again I got treated unfairly. All this rudeness is from one manager, and she's just the assistant manager. What actions should I take? Should I quit and get on welfare (HAHA)? Just call in tomorrow? Call corprate or talk to another manager?

I am currently searching for a new job, I am more concerned right now about not going to work tomorrow.

The doctors have given me a full leg brace to keep my leg straight, and I have to wear it till next week.... the manager I keep having to deal with does not care. My shift tomorrow is a short shift, no one would miss me, AT ALL

Sometimes management cannot see past the inconvenience it may cause for themselves. They aren't being paid to be compassionate, they're paid to schedule their employees. Sometimes we get these types of managers and it makes it hard to keep working there, despite how much you may like the job otherwise. Having a doctor's note is totally legitimate, and if it's not being recognized, I would suggest talking to corporate about it. If you can talk to someone in HR, that would be a great idea since they're there to mediate situations such as these. In the meantime, looking for another job is a good idea. If you have to call out, don't wait until the last minute or it could be held against you later. I would call corporate ASAP so they are aware of the situation before it gets worse.

If they didn't need you there, they wouldn't have scheduled you. Restaurants are in the market to make money, and I doubt they schedule un-needed employees, as that wouldn't make financial sense.

The first thing to do is call far enough in advance so that there is a better chance at covering your shift. The second thing to do is see what you can do to help get your shift covered. Will they let you call the other waitresses to ask who can come in? This shows that you're not just dropping the ball, and that you care about the restaurant and not just your own personal welfare.

Considering this situation seems to have already been going on for a while, take your doctor's note in with you to see the 'head' manager (preferably when the restaurant is not busy). Explain your issues, why you've had to call in 'sick', and who you've talked to. Express your concern with the rudeness of the other manager and see what reaction you get there. If it's not the reaction you were hoping for, then go ahead and take it to corporate.

And yes, quitting does seem to be the best scenario. Finding a job that will let you sit down should be your priority.

Definately file a complaint against this manager. Call the Department of labor in your State and file one through them. Managers are suposed to make accomodations for injuries to workers. Don't just quit. You don't get unemployment if you quit. If you go about it right, you might be able to sue.

Get a new line of work. Obviously you can't be on your feet. While you are on the phone with the Department of labor, find out about any programs they might for job training in a field of your interest that won't require you to be on your feet all day carrying heavy loads.
