A municipality in my area has decided to outlaw the use of any firearms or bows and arrows. There are many areas within the municipality that are rural, but fall under their jurisdiction. Do they have the right to tell someone what they can and can't do on their own property? Their goal is to restrict anyone from hunting within the jurisdiction. I contacted the Fish and Game commission and they said that the state has complete authority over all hunting but many (power hungry -my words) municiplaities will enact anti-gun/anti-bow laws to get around the states authority. What if anything can be done? Is this unconstitutional?
I can understand if they want to restrict firearms for safety, but I cannot remember anyone being killed by a bowhunter.
If their argument is for safety purposes, they should first outlaw all bars in the area. A woman was recently killed by a drunk driver in their jurisdiction. Obviously, safety of the citizens is not priority # 1.
No antihunting answers please

Work your butt off to get public officials elected who have ACTUALLY READ THE CONSTITUTION!!!!

Sorry for yelling. I'm perpetually amazed at the morons that get elected in my town. I had a City Councilman tell me recently that Texas had already outlawed AK-47s. Texas! Moron....

You need to contact an attorney for definitive answers, but DJ is basically right. Get involved in the political process and keep the anti-gun/anti-hunting people out of office. Depending on the laws covering these things in your state you might be able to mount a campaign that results in the ordinance never actually being implemented. Depending on the wording of the state law, they may not be able to restrict your hunting with a bow on your property. The key is talking to an attorney. When you do this, make sure you ask the right question. Can the municipality do this? is not the right question. Can I legally hunt with a bow on property I own that lies within the municipality? is. Who knows maybe the state's law will be written in such a way as to trump the municipal ordinance.

Contact the State Attorney General's office and ask if there are any laws to prohibit a municipality to impose stricter firearms controls than State Law's dictates.

If there are, you can get the AG to issue an opinion, and intervene. If not, you are S.O.L..

All you can do is rally the local citizens, and try to get the NRA and your State Rifle Association involved. You will probably have to go to court to get an injunction, and then fight it through.

Good Luck, you are going to need it.

As this locale is already irretrievably Hoplophobic, your only logical alternative is to do as I have done. . . . .

MOVE! ! ! !

More than likely to one of the last 'Free States', out in the Southwest, or down in the Deep South.

first look here:
http://www.nraila.org/GunLaws/
or here:
http://www.bradycampaign.org/legislation/state/
find your state and see if there is enacted a 'pre-emption' law
which would allow a city to pre-empt state law [ supersede it].
THEN see a lawyer and/or local gun club.

Please don't construe this as an anti-hunting answer but instead as a plea for you to reconsider killing some poor creature for sport. They feel pain, they really do. Don't you care if they suffer? Especiall bow hunting. Why must people be so cruel?
