my wife was hit from the back and shooved into the vehicle in front and in split seconds she was whisked away to the A&e. the cops must have gotten the car towed away. Was only released from A&e MIDNITE. we called the insurance ppl to inform them. but we're not getting any rite answers from anyone. tHE cops are saying that they're not able to lodge the report as the other 2 parties haven;t reported the incident. The person who hit the car from the back is now saying that she is hospitalised. My wife noticed that she was abt to drive off after the bang but was stopped by the vehicle owner from the front . Now, we just got a mercy car courtesy of the offenders insurer was told that they would go see if the car is ok or its a write off. What do we do next? The ppl at the tow company is sayin that we should pay n take the car out asap, y should we pay?. We're just going in circle's no one is saying anything. Should we get out solicitors involved.

Any accident where any parties have to attend hospital (whether later discharged as injuries are minor/negligible) is a notifiable accident and has to involve the police. I dont understand why they are telling you otherwise unless they dont realise your wife had to attend hospital. I would contact them and insist they give you an incident number and give them the details you have for the other car drivers and/or any witnesses. However its down to them if they do not want to act.

Your insurance company should deal with the other insurance companies on your behalf and yes someone will need to go and look at the car to see if it is repairable or a writeoff. This has nothing to do with you initially but you will be told what he has said and either told to have the car repaired or that it is written off and you will be given a cheque for a lump sum.You have notified your insurance company, I suggest you ring them again and ask what you should do re your car being removed from where it is.it is normally their decision. Your company will ask if you have a police ref number and if the police still refuse to give you one just tell your insurance company wjhat the police have said. You have reported it so you have done what was required of you. As long as you have the other drivers details thats all your insurance compnay needs to deal with it themselves

It sounds like the car behind was at fault and if she was hospitalised its even more of a notifiable accident and the police should definately be taking a statement from her before deciding whether to prosecute her for driving without undue care and attention/dangerous driving. If they will not unless you want to prosecute her for some reason I cannot see why you would need a solicitor. This will only cost you extra money and is why you have insurance.

Unfortunately it may all take a while, especially if the car is written off. This again unfortunately is not unusual and you may end up with a financial loss of some description. Even with insurance not every financial loss can be covered. You may have a case against the driver behind at a later date if you wish to take her to say the small claims court for any such additional financial loss. Then it would be a good idea to get a solicitor but it doesnt mean you would actually get the full sum or even that she would be in a postion to pay it and that must be weighed against how much it would cost you to take her to court.

Just to warn you it may be that the car you hit may claim against your insurance. Insurance companies have strange ways and technically you wife was at fault as she hit them even though she was shunted from behind. If this happens do not panic it is something the insurance companies will sort out and agree btween themselves.

Good Luck

wow, how inept can the police be?!?, whenever a car is sandwiched and the driver is taken from the scene, it is absolutely the police officers duty, to gather the drivers of the other vehicles, information all on an accident report. I would go to the police chief of that city and lodge a complaint, they may be able to establish the others involved through the towing service who are often well known by the police, due to the frequency of use as the nature of their business. For the officers to drop the ball on this, knowing full well, how important police reports are, to insurance companies, is outrageous.

Get the car out of the tow yard ASAP, or contact your insurance about it and have them know where your car is and if the impound, towing, and storage fee are covered. Here's where the waiting game starts with your insurance (if you have full coverage). If you only have liability insurance, call a lawyer to get the most out of the responsible parties insurance as well as to protect yourself
