Okay so one of my friends has been taking his moms car out at night and picking up me and a couple of other friends. Now he doesnt have his license because he got in trouble for skipping school a couple of years ago and he cant get his license until he is 18. What kind of trouble would we be in if we got caught by the police?

you will be arrested and go to jail. Seriously. It is an illegal and arrestable offense. He can kill somone.

People drive without a license all the time.

If they are pretty good drivers, and there's not a lot of traffic, they might not get caught, but accidents can happen to good drivers ... you have right of way, and some idiot crashes into you.

So the police arrive at an accident.

Aside from who is in trouble for being at fault for the accident.

One or more driver not have a license ... gets arrested, gets a ticket, car gets towed ... the police officer is not going to let that car leave being driven without a license ... the car may get melted down for scrap, or the owner may be allowed to pay a fine of a few hundred bucks to get it out of hock.

One or more driver not have proper auto insurance ... get a ticket for that, may or may not be arrested, is not allowed to drive the car away without the insurance, car gets towed, see above.

Then there is the question of whether the passengers in the car can reasonably be believed, by the police, to have knowlege of the crimes of the driver:
* driving car without permission of owner
* driving without a license
* driving without proper auto insurance

The odds are pretty good that the passengers will go to jail with the driver

Let's suppose there is no accident

Let's suppose mom finds car missing ... what are the odds she will think it has been stolen by a stranger, call police and report it stolen?

When the case arrives in court, your friend now has earlier strike against him (school truancy) and now much more serious automotive crime. The court may decide to put your friend into juvie incarceration until age 18, and ban access to driver license until age 25.

If you are all adults, you'd simply be told to get home and have a good night. But, I am going to guess that you and your friends are minors. Any minors would be, I guess "chaperoned" would be a good term, by an officer or other legal authority until they could be turned over to the custody of their respective parent or guardian. However, if your town/city/county has minor curfew laws and you are in violation of those, you could be charged accordingly and taken into custody instead of jsut being chaperoned.
There are a few potential things that can happen to the person operating the vehicle. If he asked for and received permission, then he should be okay for this part. If not, he has technically stolen the car. Now, any crime [except homicide] is dependent upon the victim pressing charges, so I doubt his mom would do that. As far as operating a motor vehicle on a roadway without a license, an adult can either be taken into custody or issued an NTA [Notice to Appear sometimes referred to as a criminal citation] and released. Or, the officer could take the individual into custody and arrest them. Either way, they will NOT be operating that vehicle to leave the scene. The registered owner of that vehicle will be contacted, if possible, and they MAY give permission for someone else present at the scene to operate the vehicle so it does not have to be towed. The police can NOT let anyone they arrest leave the vehicle parked and unattended where they make an arrest. This prevents someone coming along and vandalizing or burglarizing it and the owner suing the PD. The end result is that either the owner will have to come get the vehicle, it will be turned over to the custody of a person designated by the owner, or it will have to be towed and impounded.
Okay, I guess I have to be all "growed up" and say, sternly and seriously, "Don't do it. It's wrong, illegal and could get you hurt or worse, killed." But, being all "growed up", that means I was once a teenager. And, I remember my nights out late driving around with friends to different places and houses. And, yep, sometimes my buddy's license was suspended, but never revoked. And, being the son of a retired police Sgt, I knew full well what the end result could be and did it anyway. Bottom line is: be smart and safe and not stupid and sorry.

Enough to make you stupid if you are smart enough to ask this question, and are still riding with him.

Firstly, though at base level, you might not get in trouble if you're not driving, unless you are older than he is, that might cause some issue.

Of course, you could be taken in for joyriding, depending on where you live.

On that note, you will ALL be in hella trouble if his mother calls the car in as missing, then you could easily be taken in for theft.

Finally, more than likely, if it gets bad enough, and you are pulled over for more than just .. driving... your friend could very well lose his privilege to have a license for years, or even permanently, depending on the circumstances why his is 'suspended' now.

But, if you're smart enough to realizing you're breaking laws, why are you dumb enough to break them?
Youth, ignorance, arrogance, irreverence, and a sense of adventure. Enjoy it while you can. I know I never did.

Why don't you get your mom and your friends to read this? I think everything will be fixed before the cops are involved.Don't be stupid and ruin your whole life for a quick thrill, as far as your so called friend, he's already stealing cars and involving the rest of you guys. Is that what you really want?

It depends on why they pull you over. But, if they pull you over for something stupid like a pair of fuzzy dice hanging from your rear view mirror, then chances are they're going to get you for everything they can, plus if there are no licensed drivers in the car, they will tow the vehicle.
They try to make examples out of teen drivers, because they dont want you doing stupid stuff like that anyway.

You? None to speak of, aside from having to walk home from the bad side of town when he gets arrested.

Do keep in mind that he has no insurance since he's unlicensed. If he wraps the car around a tree, there won't be any $$$ for your medical bills.

depends on the cop if he is a nice cop he will tell you to pull over and go home walking and tell your mom to pick the car up...


but if the cops is going to act like a dik he will give you a ticket impound the car and suspend ur license till ur 21

Grand Theft Auto, and if you hit someone it'll be Murder 2nd because of killing someone WHILE committing another felony. That'll take the fun out of it!
