It was a legit contract VIN# and all with a major dealer, we already told them we weren't falling for the bait and switch when they couldn't come up with vehicle we signed for. Now two weeks later, we found out from the bank that the dealer paid off our loan. We're wondering if they just bought our trade? Is something going to come back to us?

It sounds like they bought the car.

If there is a difference between what they paid, and what they got and it is in your favor, you should get something.

But don't count on it.

Since you had the VIN number, why couldn't they deliver? The contract says that you were to buy one certain car. They are in default on the contract, so the contract should be void. If the contract is void then you should get your car back with the payments. It sure is a mess now. The dealer gave you some reason for not delivering, was it that they just didn't get the car from another dealer. A lot of times they will trade cars so whoever can sell the car first will get the sale and the car will be delivered to their dealership. It could be that they had an agreement and at the same time the dealer that had the car sold it himself.

Bottom line, if you can't work things out on a new car, then you'll get the old one back with the payments just like before. good luck.

What is the dealer telling you? It would seem that if the dealer paid off the loan, they bought your car. If this works for you let it go as is, if your car was worth more than the payoff, fight it. Legally, if they can't deliver on the contract for any reason, the contract is void, and they must return your car and any cash you gave them.

I agree with DodgeMan, If you signed a contract and they paid off the car. Then the car is theres now. and the must deliver on the car you agreed to . If not , I would definately get a lawyer. {If this is a large dealership you should have no problem, They don't want the negative press}

with them paying the car off technically right now it belongs to them,if they cant deliver on their end of the deal they,ll have to get you a car.they are obligated to do this ,it should be written in the contract stating this,you have a right to get the vehicle you signed for,and they know this,make them deliver one like you signed for,or get your old one back,they have no choice but to honor this agreement,good luck on it.

if you still have the car.. tell the dealer thanks.. if he has it.. call a lawyer.. if you have one of his cars..let him worry about it..
