I don't want the house, but I don't want to walk away with my name on it, he is already messing up my credit. I've had to max out my credit cards because he doesn't help with the bills like he should. He drives a truck, doesn't come by the house much which is fine, but he takes out what he wants to play and gamble and sends what's left which sometimes isn't much. I work two jobs, and I'm trying to get caught up enough to get out of this situation, but I need a break. Help wht can I do?

First of all you need to establish a different checking account through a different bank then what he uses. This way you can guarantee that he does not have access to your account. Next start making as large of payments on your cards as possible. Make him keep up on the house with his paycheck. Only after you pay down your debt I would suggest that you file for a divorce. This way you can use him as a crutch to get you out of debt. I would also save some money too. Just so you have a good start as being single and to pay the lawyer.

The first thing you should do is notify the Credit Bureaus that you want to be notified of any new inquires. Call Trans Union toll free @ 1 877-322-8228 and request your free credit reports. As suggested , get your own checking account. . If you have any joint accounts, close them. Being in debt for $42,000 is a lot of money. I usually don't suggest this but have you thought of filing Bankruptcy and include the house and debts?

Sell your house and move into an apartment or mini-home. You might make money off your house to help pay down your debt. If you need to, get a court order that forces him to pay you $x/month if you are eligible for him to be paying you.

File for divorce and let him have the house in the settlement .

Wait , a house under $100 K ?
You should be able to sell that (if not in Detroit) and use the extra proceeds to pay off the $42K !
