Last night I was backing out of my friends driveway and as i was turning my wheel i bumped into a parked car parked on the opposite side of the street. It was a very bad place to be backing up, with low visibility all around. I did some damage to his his car nothing major. I was only going about 6mph. We made a police report and everything. He has Michigan no fault insurance. I have full coverage. He had an old 1989 jalopy. I have an 07 Acura Rdx. He basically told me he doesn't care about his car but he wants to get the most out of me he can get. He kept saying he bet he could get 4grand out of me. I know Michigan is a no fault state and that each person is liable for their own damages. But how exactly does this work with his car being parked and not having full coverage? Will my insurance pay? Would they only pay up to the amount his car is worth?

the police came took his information. But when it came to take my information they wanted to see the damage on my car but my brother had dropped off my friend who was with me. They took about 4 hours to come. So they were real ******* they tried to charge me with leaving the scene and everything. But the point is they took my license and registration down. But they didnt ask for my insurance info so they dont have that information. They then in turn gave me a ticket for no insurance. Imagine my frustration. They were Detroit police BTW. No people skills what so ever.

if he has an 89 junker then the most the car is worth is 1000 dollars. your insurance will pay for the damages to the extent the car is worth and no more. so there is no way he will be getting 4 grand. by the way no fault insurance just means that if your hurt in a car accident even if it isn't your fault, your own insurance pays for the medical bills for you up to the limit your covered.

A Michigan no-fault policy provides unlimited medical and rehabilitation benefits. It provides wage loss benefits for up to three years, and $20 per day for replacement services if you are injured in an auto accident, regardless of fault. In exchange for these benefits, Michigan motorists gave up the right to sue in auto accidents except when someone is killed or very seriously injured. Because of this, disputes over who was at-fault in an accident will not hold up payment of medical bills. Michigan is unique in that damage to vehicles also falls under the no-fault system. This, too, saves time and money in claims payment. Michigan drivers must buy collision and/or comprehensive insurance to cover damage to their own car.

So even if he wanted to sue your insurance company Michigan Law prohibits him from doing so. Technically even if he did sue your Liablility insurance cover HIS claim (collision would cover damage to your car) would cover the claim, and if you have had your insurance for more than 6 months your premium would be unaffected by the claim. It doesn't matter if he does not have full coverage in Michigan, it is his own fault, everyone who lives in Michigan and has auto insurance knows unequivically they are not allowed to sue another drivers auto insurance company due to damage to their car.

This may varry if you have out of state coverage, but I would imagine that because it is the law that the law in the state where the accident occured would trump where your insurance was bought.

Dont even talk to him. Have him call your insurance. Your insurance will deal with him. You dont even have to mess with him. If he sues you, your insurance will take over and probably sue him back.

Just say you have my insurance information. And no they wont pay more then the car is worth. That old they will probably say the most we are giving you is 800 bucks for a total.

Thats assuming they give him anything. Lose his number and dont say a thing to him, refer all calls to your insurance company.

YOU LEFT? Holy Hell you have balls. Im suprised they didnt arrest you. Your insurance company is going to love you. I would be looking for a new insurance company. Im pretty sure you wont have them when this is over. You cant testify as what happend during the time you were gone. If he got hurt when he opened the door, and you had no witnesses.

If you backed into him, you owe him the damages to his vehicle, or the worth of the vehicle if that's less. Yes, your insurance will pay. No fault doesn't mean damages don't get paid, it refers to the medical side of things.

If you allowed your damaged vehicle to leave, you could indeed have been arrested for leaving the scene, they were only doing their job and you apparently didn't make it any easier on them.
