i have this question for anyone to answer i have a five year old son who is parlized from a car wreack 1 year agoand the school will not let him go to kg because of his disability should they let hiom go on and be with kids his age

If your son has no other disability's besides being paralyzed then there is no reason why he should not be attending a general education kg class. Now if there were other disability's associated with this like if he suffered head trauma and was delayed in something like speech,learning or something else and they felt he would not learn as well in a kg class then they can (with your approval) find another class like a self contained program where he might be able to learn better then in a general education class. All of this would require the development of an individualized education plan (IEP) where all of this would have to be specified. You as the parent have every right to determine what kind of education your child receives. It is against the law to refuse any child an education regardless of their disability's.

Every child has the right to an education, even a physically and/or mentally handicapped/disabled child. Your son, who is five years of age and shows the ability to handle the kindergarten course should be allowed to attend kindergarten. I would fight the school board on this- get in touch with the your states legislators if the need arises, because there are laws to these kinds of things! Even a mentally retarded student has the right to an education; special education classes may be more appropriate for that student, but he/she has the right to the education. Just because your son is paralyzed (physically disabled), that does not mean that he is incapable of learning in the same environment with the other students. Special accommodations CAN ALWAYS be made! Fight this and do not give up until you have won!

Under Public Law 94-142, passed in 1975, and P.L. 101-476, in 1990, all handicapped/disabled students between the age of 3-21, shall receive any special services they require from a public school receiving Federal funds. I suggest you contact an attorney.

First, let me say I'm so sorry for what has happened to your son and your family you are in our prayers. Yes your school should let your son attend. It is quite normal for a child that is in a wheelchair no matter what may have happen to them to be allowed into a school. Best of luck to you and your son. I'm not sure the school can prevent him from attending. Children with all sorts of mental and physical handicaps attend the schools here in KY. Can't see why it would be different where you live. Talk to an attorney or a social worker, maybe. The school is discriminating against your child and that is not allowed.

If he still has the mentality of a 5 year old he should go to kg. I would go talk to the principle or school board and ask why they are not allowing him to go. If they state something about policy, then ask to see the policy. If it is a matter of a staff person having to push his wheelchair or help him with things then ask them what services are needed for him to attend.

They have to accomodate your child or help you find a school that can help you(for example if they do not have a special education department). Most school districts have them. If you are in the US there are federal plans that protect your child. I would call your school districts special education department and find out what steps you have to go through. They cannot discriminate against him it is against the law!

The fact that he is paralyzed certainly doesn't make him not allowed to attend school. Is he in a wheelchair? I'm very sorry about the car accident.

The school should be able to make accommodations for your son to be able to attend. If he is up to it, wants to go, then by all means, send him. For him to interact with other children would be a great thing. :)

Of course the school should let him attend school, he is just another kid, with dissabilities or not, he deserves and has the right to get an education. Maybe if he is with other kids his age he will be happier.
