IM ASKING THIS QUESTION FOR PROOF TO TELL MY CUSTOMERS THAT ILLEGAL/UNGENUINE SYSTEMS MUST BE REMOVED.

I believe if a person has an illegal or ungenuine copy of Windows XP/Vista, it must be removed due to privacy and laws. Am i right?
(I need people to back me up on this question).

If someone installs a ungenuine copy of Windows XP on their computer for private use and then wants to SELL THAT COMPUTER, THEY HAVE TO REMOVE THE SYSTEM, YES?
I know that illegal/ungenuine systems are not allowed to be installed, but what if a person installs it themselves and keeps it for themselves, they then need to remove the system when they want to sell the computer, yes? Because the system is illegal/ungenuine... The purchaser has to pay for their own legal/genuine copy of Windows.

## I need answers to back up this case. I have people which need to be told this. I will print off all answers.. ##

fraudulent software is illegal.
just as is fraudulent hardware - stolen goods e.t.c.

it depends on the country's laws as to whether the buyer or seller or both are breaking the law when a transaction of illegal products/goods takes place.

Sometimes it can be illegal to buy but not to sell or visa versa - stupid I know but you'd have to check the laws of the land and what liability you the mediator of the transaction might also have. - That would depend of course whether you simply hold the goods for sale or buy them off of the seller and then sell them on. - do they enter your ownership?

Microsoft owns the copyright to all its products, which includes Windows XP/Vista. Pirate copies are illegal but there's plenty of them available. They don't always work properly and will not be up-dated by Microsoft on-line. If a computer is sold with a pirated copy of Windows it may be difficult for the purchaser to tell at first, unless they know what they are looking for. Also, I wouldn't have thought the purchaser would be expecting the operating system to be missing! I don't see how you could force anyone to remove a pirated Windows before sale but the purchaser would in my view have a very good case in law for misrepresentation, in that they would reasonably have expected the Windows version to be genuine.

Whether you sell a computer with a pirate copy of Windows or if you buy a computer with a pirate copy of Windows you are still using Windows in contravention of the licence agreement with Microsoft. It's not legal. People do this because they think they can get away with it and that Microsoft will not prosecute. That's probably true if you are a two-bit individual but Microsoft can still make life difficult. They can deny you access to updates and woe betide you if Windows Activation ever gets triggered. If you keep any files of any importance on your computer then it is not worth it to run a pirate copy of Windows.

Let me see if I can answer this in simple terms.
When you purchase a computer it comes with windows on it and from there you are required to REGISTER your windows Software, This makes your Windows copy as you are the Owner of that Legit Copy of Windows.
So if some moon gives you or sells you a copy already on another machine 2 things occur.
You must have the Key Code to Unlock the copy
If it is already on a machine it may download and it may not because Microsoft knows that this copy is not registered to the original registered owner, They are not stupid.
You will not be able to update this Illegal copy.
Save yourself a ton of Headaches.
Go Buy a Full Legal Copy of Windows

There are many cases of people being told their version of Windows is not legal. MS do make mistakes. A computer O\S is govened by the license number on the sticker. If the stickers say XP home and is a real sticker, and the system is XP home then it could be one of MS WGA errors.

It's down to MS to inforce the law not you. Illegal versions of XP will continue to work as MS know their WGA system is flawed and stopping it running would cause untold law suits.

So a little notice and no updates is the most they can do to what WGA has classed as a pirate copy.

There are all kinds of people busy making up all kinds of laws. According to certain laws, you are not supposed to use illegal systems at all. Hence the appellation "illegal". However, as with most laws, it is next to impossible to enforce. What will happen with such a system, is that you will not be able to get updates. The computer tech here in our small town installed illegal XP in all of the library computers. They have been working fine all summer, except they can't get updates.

I think you maybe surprised then about how many people, including COMPANIES that put illegal copies of windows on pc's!!!

For example, there is a computer shop in sheffield town centre, (UK) that puts copied versions of windows xp pro on EVERY pc that they sell!!!

On a different note, there is a way that you can install an illegal copy of windows onto a pc & trick windows ni thinking its Genuine!!!

Well if you have a illegal copy installed now then you are already stealing.

Would make you a crook twice( if thats possible) if you sold it with the pirated copy on the computer.
THEY HAVE TO REMOVE THE SYSTEM, They should but they don't have to.

having any pirate software is illegal and you can be arrested for it, when you sell the computer it is unfair for the purchaser to be punished for something that the previous owner had done, so to prevent any upset or law involvement all illegal software should be removed before given to someone else.

Heck you shouldn't even have the software on there in the first place

You are OK until you update.
At that point you have 30 days.
Then ... No more windows.
I would save anything you want to save, to CD/DvD Rom,
Flash drive or whatever.
Format the drive and reinstall your legitimate copy of WinXP.
