My situation: my husband worked one month out 2007 I have worked all year and we have a 2 year old we will be filing joint and i checked to see if our income is within the guidelines it is but the question is since i am the only one working and we have a qualified child can i claim this credit?

Yes, you can claim earned income credit with only 1 working. Earned income credit doesn't matter if married and only 1 working. What matters is income level, and unearned income.

To qualify for EIC,
* your status cannot be Married filing separately, that is you must file as Married Filing Jointly.
* Your Adjusted Gross Income must be less than $34,001 (this is 2006 amount; 2007 limit should be slightly more than this).
* You must be U.S. resident for whole year.
* Your investment income must be less than $2,800 (this is 2006 amount).
* You must have earned income.
* The child must be your qualified child and can't be qualified child of any one else.

Yes you can as long as you meet the income guidelines. There is no requirement that both spouses have earned income, just that at least one of you does.

Sounds like it, based on what you said. You don't both (or either) have to work all year, if that is your question.
