I don't think the founding fathers gave us a right to eat peanut butter sandwiches in public. I agree that this seems extreme, but it's pretty similar to how people often react if they learn a child with AIDS is at school--despite the fact that the child would have to BLEED on another child who happens to have an open wound to infect them (or have unprotected sex), the risk is high enough that the infected child is often barred from attending the school.
It's like that with the peanut allergy. While it's highly unlikely that you might accidentally brush the allergic kid with your hand or sleeve or something, transferring a microbe or two of peanut butter where he could then breathe it or wipe his eye or his mouth, the result if you did is that he could go into anaphalactic shock and DIE. So... why not just save the peanut butter for after school?

The school can do that. A school is not a restaraunt and they don't have to cater to your meal preferences. Also, they have to be concerned with the safety of the students. That "one' kid at your school could die if he/she has any contact whatsoever with peanuts. That is a major concern. The oils from the peanuts can actually get in the air and the person can breathe it in. That's why airlines give out pretzels instead of peanuts now days. You said you went to a school that was K-12? Is it private? If it is, they could impose any policies they want. Most public schools have the freedom to impose many poicies too. I've never seen a constitutional right dealing with school lunch preference but I have seen cases that deal with the school's liability to take neccessary precautions to protect students with certain disabilities, i.e. peanut allergies. It's called the American Disability Act.

peanut allergies can be deadly in a matter of minutes. Whether or not it is against your rights, is it that bad to keep peanuts out of the lunchroom? Can you have a PBJ for dinner or as a snack? Sometimes we have to do things we may not like for the best interests of those around us. Maybe it is a poor analogy but it is kinda like smoking bans. Can someone get cancer just from seeing you smoke? No, of course not, but we still have smoking bans. I would say, just go with it and try not to make a big deal of it.

It is against your rights but its for a greater good. Some people have such severe peanut allergies that if you eat your PBJ then drink from a water fountain, then they drink from it they could die. A woman I work with has a peanut allergy and she isn't able to kiss her husband if he has eaten it. Try not to be too angry, people with this allergy really have it tough with so many things they cant eat, because its possible they may have a trace of peanuts in them.

you have your rights to life liberty and the pursuit of happiness unless that pursuit endangers someone else's life. some allergies are so acute that just the smell could kill. daniel b you are an idiot if it was your child with an acute allergy you would do anything to protect you child otherwise you are a poor excuse for a parent

Sorry, kids have very few rights in the eyes of the law....ESPECIALLY at school. Given this substance is known to be fatal to at least one child enrolled, the school administrators would be stupid to NOT ban peanuts in this sue-happy nation. It's not right, it's just the way it is.

Is it against your rights? Good question.
Tell them it is against your right to privacy to question you about your food choices......
Hey if it works for killing preborn babies, it should work for your peanut butter and jelly sandwich.
For all the Liberals out there, isn't this childs death part of evolution?

I think there is more to the story than you are giving us. Rules are rules though so you'll have to wait til you get home to have that sandwich. Glad someone likes it as much as me.

Possibly, but you'll need to consult an attorney to be sure. The question is, is this worth the fight?
