I am trying to get out of my apartment. My roommates is the only one who signed the lease. He is buying a house in October. We heard that you can break a rental agreement if you purchase a home (good for the economy and all that) but I can't find the info. Where should I look?

Breaking A Lease In Kansas

You'd have to check with your city and/or state Housing offices. Just go on your State's official website and look for housing information... or go to your city's city hall and see if anyone can help you in there.

Usually you cannot break a rental agreement for any reason except for death, abuse by the landlord (not doing repairs in a timely fashion, invading your privacy with too many unannounced visits, theft or damage to your property, etc.), or natural catastrophe (tornado destroys apartment complex, for example).

The penalty is obviously whatever is stated in the contract (usually one or two months rent plus forfeiture of security deposit). Now since your roommate is the only one on the lease, technically, he's the only one responsible for the penalty, but it sounds like you don't want to screw him over. But if you have until October, what you can try to do is try to find a subletter who'd take over your lease until it's up, and then if they want to stay, they can renew with the apartment company fresh in however many months. Post on craigslist.org in Kansas and see if you can get any responses. If not, you might be out the hundreds of bucks in penalties if you break the lease.

Y'all heard wrong. Read your lease. It should say what the penalty is for early termination. You can try to negotiate a settlement with the landlord. But as a minimum you will forfeit your deposit and probably have to pay another month's rent.

No you cant. The rental agreement is a contract between you (your roommate) and the landlord, so if the lease is broken, penalties will have to be paid.

Uh no, that is an animal that doesn't exist.

Read the section in your lease on breaking the lease....THAT is the procedure you will be required to follow.
