if the judge in a custody case orders both parents not to visit children untill a date for a hearing is held and one parent violates the order and not only visits but has the children at there home is this considered contempt of court if so what is the normal penelty if any

It is contempt of court. The penalty could be jail or a fine. This is the Judges decision. If there was an order from the Judge, how did the parent obtain custody of the minor(s)? Whoever released the child/children to this parent could also be in trouble.

Yes it is comtempt. Depending on your states laws and your agreement they can possibly be arrested. Usually the police will not arrest them as to not create more drama for the children but I would file a report because that will help your case in court because it shows that they do not follow orders, and that looks bad for them in the eyes of a judge.

You should call the police that is contempt. You will need the police report in court.
