This is the sencond month they have been tenants. Their first rent was 4 days late, their second rent was 3 days late. They have yet to produce proof of renters insurance (I do have the property / dwelling covered, yes). I am concerned that the reason they have not switched the ultilities is because they are having issues with credit (it was average, their inome was sufficient and they arranged a co-signer for the credit). How should I handle this?? They tried to tell me they would give ME the payment for the bills and I could send it in, and that they will "be sure to take care of getting the name switched on the account." But, I was not very happy with that solution and asked them to contact the utilities first.

If it is in your lease that the tenant is responsible for the bill, you can fax the lease copy to the tenant given the tenant signed it and the util co. will go after them instead of you. I would try getting the util money. Go see them in person and stand there with the amount due. Have the eviction notice and demand for rent in your other hand. If they don't pay then hand them the notice and foward the lease to the companies. Hopefully, it isn't too late and you can keep their security deposit. Don't wait. Do it now, as the law is horrible and might side with the tenant for some reason. That means they will get an extension to stay. Do not have the utils disconnected as it is most likely illegal to do that in your state.

PAT, if you have a MTM rental agreement and the contract states they pay the utility, just call in and have the UTL shut off or give them a 3day-30day notice to vacate and file an Unlawful Detainer action against them and remove the funds from their deposit to pay for the court action, further do this the moment they pay rent ( if they do) and then you have 30days to get it done and not cost so much to you if their deposit is not large...you need to have all your deposits at 750 or more or same as your rent as long as its more than 750.

what does the lease say about who will be responsible for the utilities?

where this is matters. And you didn't tell us.

In the Socialist haven of Burlington, Vermont the landlord is responsible for the electric and water no matter what your lease says. It's a city ordinance.

google will help you find your state and local laws on the subject. They'll tell you want you can and can not do -- including whether this is sufficient breach of contract to warrant termination of the lease and eviction.

if they are giving you late rent and then have the nerve to run up utilities that's not in there names sweetheart they have been there 2months 2 long there credit situation is not your problem your mortgage still has to be paid if they couldn't afford the apartment and utilities for more then 1or 2months then they shouldn't have moved in and why do they want to give you money to send in when they can just put it in there names sounds to me like your tenants are up to no good don't wait until they run the bills up and skip out loose these irresponsible people now.

Contact the utility company and have them disconnect the service in two weeks. Then, politely tell your renters that you went ahead and had the service discontinued in your name on that date, so they can contact the utility company to have it switched into their name on that date. If they don't get service arrangements made with the utility company, it'll be a cold winter for them. But at least you won't get stuck footing the bill.
