Would I pass a criminal background check?

About 2 months ago, I had a fight with someone. She hit me first and we started fighting.I didn't cause any broken bones, bruises or cuts. The person pressed charges.I went to the precent and was charged with assault 3. I am due to court in sept. I'm having a background check for an apartment in mid sept will I pass or will this incident come up. This took place in NYC.

Assault is verbal abuse. Battery is physical. I don't see a problem with your charge unless the apartment landlord may consider you a trouble maker.
