Ok, SO if a restaurant has a sign or something that reads, "No Photography," and say a paparazzi has a camera and takes some shots of someone inside the restaurant, can that person sue?

No, you have no reasonable expectation to privacy in a public place.

The restaurants sign would fall under the idea that they have the right to refuse service to anyone. If someone is taking pictures they have the right to remove them, but they can not be sued.

No. With a very few exceptions, it is perfectly legal to take photographs in any place where you can legally be. And the copyright owner of a photograph is the person who takes the picture, not the subject who is in the photo or the owner of the property you happen to be on. Nor can the owner confiscate your film without your permission. However, the owner of the establishment can certainly kick you out and ban you for not following his rules. And a restaurant is actually considered a "public accomodation" under the law, so no reasonable expectation of privacy applies there. If you were taking pictures of people in the bathroom, though, it would be a different matter.

There is no legal basis for the "no photography" policy of the restaurant, it is just their policy. The photographer can be thrown out or banned from the restaurant in the future but I don't see a legal case to be made. I guess the person could sue as an invasion of privacy whether or not it involved the restaurant but it would be a pretty weak case as the restaurant is public.

probably no...the restaurant is trying to protect its identity and what the restaurant looks like inside...and probably also to keep the customers from being upset (bad ambiance).

but here is where the line is drawn about pic taking ---if you are well known (like a star --tom cruise)....you really have expectation to the right of privacy and unless the person(s) taking the pics do something totally outrageous, they cannot even sue that person taking the pics...(there are certain cirumstances).

BUT...when it comes to you and I---we are not well known and there IS a certain level of expectation (legally) to our right of privacy. so we can sue if someone takes our pic without our permission.

Signs are just signs if you are in a restaurant you expect to be seen by others if however you are sat on the toilet and someone takes a photo you have had your privacy invaded. If you are famous you should just get on with it.

No. There is no right to privacy. The restaurant manager or owner can have the camera and man removed from the premises.

That depends on whether the paparazzi was inside our outside the restaraunt.

If they are outside, the answer is a definite "no".

If they were inside, the answer is "probably not"
