You admit that you ran the red light, and by running that red light, you caused an accident. If you could not see that the light was red, then how do you know that it was? The fact is, you ran the light and you know you ran the light. Of course they can charge you. You aren't going to lie while giving an official police statement, are you? That's called obstruction and can get you in even more trouble. You are better off to just admit what happened and tell the judge why it happened. Take some pictures of the intersection as it would be as you approached it, and bring them to court with you. It might help a judge understand what happened.
Good luck.

I've gone through a red light, i must admit a few years ago i got pulled up straight away and was cautioned, went to court and got a fine and points the police got the road wrong IE where it happened and I still got done even when my brief objected. we did not have the camera's we have now, take photo's of the junction, if poss take video footage of the junction with the sun as you describe , DO NOT SHOW THIS TO THE POLICE, tell them you have, it if they caution you show it to your lawyer, it is for them to prove you guilty, and by the way it is not driving without due care or dangerous driving it is far less of a crime an will probably be dropped

If they were going to arrest you they wouldn't book a suitable day in advance! They will want a statement from you or to check the one you have already given especially if it is to be used in mitigation. Just tell the story you have told us and answer their questions truthfully. Based on your statement they may want to try to do something about the lights (recommendation to the council who maintain the lights), especially if you are not the only one. If you didn't kill anyone then you wo't be going to prison although as stated above you may get a fine and some points... and possibly a thank you for saving someone else from serious injury.

The short answer is yes, they could. But........
By the sound of it, they just want to get the facts straight, and you'll probably just get a bollocking. You ARE guilty of going through a red light, and in law, there's no excuse - but under the circumstances, and as it was only a little "ding", I'd be surprised if you get nicked. I reckon an official warning.

If the police want to talk to you and have left it this long without placing you under arrest then i would say that they are as confused about the RTC as you are. Dont worry too much, if you were going to be in the crap you would have heard by now.
On another note failure to stop at a given signal carries 3 points and a fine at best. good luck.

By your own admission you drove through a red light you broke the law the police can obviously charge you.The fact the sun was shining is irrelevant.

The important thing is whether or not you were warned of possible action at the time or within 2 weeks of the offence. Generally a verbal warning at the scene doesn't count. If they want to charge you they should have sent a"Notice of intended prosecution" within 2 weeks of the offence.

while you're making use of under the effect of alcohol or the different substance your concept and reflexes are going to be down. If the driving force grew to become into inebriated he could desire to be charged with DUI and manslaughter. in case you get in a automobile on an identical time as under the effect you're breaking the regulation earlier you bypass away the dooryard. in fact, maximum states can cost you with attempting to function while you're under the effect and entering right into a automobile with the objective of working. it is not regularly anybody wins a case in court by skill of announcing, particular i grew to become into inebriated even though it grew to become into the different adult males fault :)
