i can't afford to pay this. do i have any recourse

If you haven't opened the packages, return the cigarettes. Do you live in PA? I've seen other persons mention in yahoo answers that they live in PA and also got busted by their state tax dept for buying cigarettes from the indians.

You broke the law by evading the tax in the first place. Now no, you don't have recourse other than to pay what you owed in the first place but evaded. Some states have started really cracking down on this. It's not a new law, it's just that people had found ways to evade the taxes that have been on the books for years, and the states (PA is one) finally figured that out.

Having said that, first you need to verify the amounts they are charging you for, make sure all shipments are correct and not overstated in quantity or amounts.

Then ask to set up a payment plan with the tax agency, I have to believe that they would rather receive some money than no money.

And you can always take out a personal loan or wait for the state to file liens and go and file bankruptcy.

You don't mention what state you are from. You should inquire what the tax agency policy is on making payments. If you stopped smoking you would solve this and a host of other problems.

I think they charge 75 cents for each Illegal smoke here at home. The option given to the person I met was time in jail instead of payment. I think there in jail as we speak.
If your credit is good you could try a personal loan.
