my mum asked me this so I'II ask you if the next door neighbour at my mums house as a apple tree and they are falling into her garden can she rightfully make my kids a apple crumble from them?

Yes she can as his tree is encroaching over your mums property so whatever falls off the tree is hers to keep.

Just be careful though, look at what happened to Sleeping beauty!! lol x

If they are falling in your neighbor's garden they are rightfully hers and you should not trespass on her property, if she is home, politely ask her if you can have those apples if she is not planning to use them herself, otherwise stay off her property, she might want to have you arrested.

yes. Possession is 9/10 of the law. It may be his tree but if the apples fall in your yard or in the street they are fair game..

if the apple fall into your yard they become your apples .. do what you want to do with them.. eat, cook, sell.

If the tree limbs are hanging in your yard you also have the right to trim the limb too but to be nie to your neighbor I would ask him to trim the tree.. before I went that far. It would be better to keep a good neighbor than to have an enemie.

For as long as they are attached to the tree, they belong to the neighbour. If you pick them off the tree, you have to give them back. If they fall off (without you helping them!) you can keep them.

Yes they are on your property so you are entitled to use them, if you ask your neighbour I'm quite sure they would give you a few more.
